CONSENT CALENDAR: 4.1 Non-Public Hearing Items 4.1 a Approval of General Plan Consistency finding for the vacation of Brite Street on the east side of Oleander Avenue. (City of Bakersfield) (Exempt from CEQA) (Ward 1) 4.1 b Approval of General Plan Consistency finding for the abandonment of reserved public utility easement rights in vacated 1St 2nd 3rd and R Streets west of Tract 1396. (City of Bakersfield). (Exempt from CEQA) (Ward 1) Motion made by Commissioner Blockley, seconded by Commissioner Spencer, to approve the non-public hearing portion of the Consent Calendar. Motion carried by group vote. 4.2 Public Hearing Items - None 5. PUBLIC HEARING — Vesting Tentative Tract Map 6281 (McIntosh & Associates) (Ward 4) Public portion of the hearing opened on February 5, 2004. Applicant has requested a continuance of this item until the next Planning Commission meeting. Minutes, PC, February 19, 2004 Page 2 Renee Nelson, representing Clean Water and Air, asked to be put on the record with her comments. She stated her main concern is that the tracts coming into this vicinity are not reflecting the cumulative totals accurately from report to report. She then displayed a map of the area that did not reflect tract 6250 which is adjacent to the property and not included in the cumulative impacts. She doesn't understand why, if they are looking at things in a one mile radius, this map was not included. That map is 423 dwelling units on 104.5 acres of land. The ROG totals are 9.69 tons per year and the NOx are 8.62 tons per year. The graphs show that 6250 showed 2.94 tons per year of ROG and 2.91 of NOx as opposed to the report which almost triples those amounts. It puts them over the 10 ton per year suggested threshold for the cumulative impacts for ROG and NOx and the Commission would need to make an overriding consideration. The data that is in the report mentions that compared to the whole air basin its not a cumulative effect because it is such a small percent that is not allowed as a basis for methodology. Ms. Nelson said she sent a summary to the Planning Commissioners after the last meeting of the law — Kings County Farm Bureau vs. City of Hanford — so that they may have a better understanding of how cumulative effects work in an air basin. Roger McIntosh, representing Castle and Cooke, stated they would like the opportunity to continue meeting with staff about access issues and circulation inside the tract. Commissioner Tragish said that he forwarded his copy of the Kings County Farm Bureau vs. City of Hanford to Ms. Gennaro for review. Commissioner Tragish asked Mr. Grady if we have the power to allow streets to be narrower than those required by the codes where there is not a PUD? Ms. Shaw said "no." There were no other speakers. Public portion of the hearing remained opened. Commissioner Tragish made a motion, seconded by Commissioner Ellison, to continue this item until March 4, 2004. Motion approved by the following roll call vote: AYES: Commissioners Blockley, Ellison, Lomas, Spencer, Tragish, Gay NOES: None ABSENT: Commissioner Tkac 6. COMMUNICATIONS: None 7. (COMMISSION COMMENTS: Commissioner Gay asked if there would be a benefit to the Commissioners to meet with them for a discussion on what leap frog development is and what real conversion of ag land is? Mr. Grady said he could either give a presentation or give something in written form as to what staff considers when reviewing projects that are converting ag land.
