A RESOLUTION DISPENSING WITH
BIDDING DUE TO EMERGENCY SEWER
LEAK.
WHEREAS, on Monday, September 19, 1994, the sanitary
sewer force main on Stockdale Highway near the Cross-Valley Canal
sprung a leak which threatened to allow sewage to spill into the
canal; and
WHEREAS, City crews were immediately dispatched to the
area to perform an emergency cleanup of the spill and a temporary
repair of the leak; and
WHEREAS, on Tuesday, September 20, 1994, the Public
Works Director was informed that the temporary repair did not
hold and some sewage had leaked into the Cross-Valley Canal; and
WHEREAS, the Public Works Director determined that the
sewer force main break would require outside forces in addition
to City staff in order to remedy the problem; and
WHEREAS, the Public Works Director determined that the
continued leakage of sewage into the Cross-Valley Canal
constituted an imminent risk to public health and that the
immediate preservation of the public health required the use of
outside forces to repair the leak and insure that no future leak
would occur that might pollute the Cross-Valley Canal; and
WHEREAS, in order to remedy this emergency situation,
the Public Works Director authorized engineering and construction
services on a time-and-materials basis to engineer and construct
a bypass system and new sewer pipe in order to prevent
reoccurrence of the leakage.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. The above recitals are true and correct and
incorporated herein by reference.
2. City Council hereby determines that based on the
above recitals an emergency impacting the public health existed
thereby allowing the dispensing of bidding requirements or
bidding procedures as set forth in Section 136 of the City
Charter and Section 3.20.060 of the Bakersfield Municipal Code.
