HomeMy WebLinkAboutRES NO 161-94RESOLUTION NO. 1 6 1 - 9 4 RESOLUTION INSTITUTING COLLECTION OF MAINTENANCE AND OPERATING COSTS FOR FUTURE CONVENIENCE TRAFFIC SIGNALS THROUGH MAINTENANCE DISTRICTS. WHEREAS, a "convenience" traffic signal is a traffic signal not required by the Traffic Authority to regulate traffic flow, but is a traffic signal installed solely at the discretion of the developer of a commercial site; and WHEREAS, developers often request permission to install convenience traffic signals on major streets to enhance access to a specific development; and WHEREAS, such convenience traffic signals do not provide a general public traffic benefit; and WHEREAS, each signal system costs between $4,000 and $6,000 annually for maintenance and operation; and WHEREAS, under the "user-pay" concept, the private property deriving benefits should bear the costs of maintenance and operation of convenience traffic signals; and WHEREAS, Section 13.04.020 of the Bakersfield Municipal Code states, in part: "The purpose of this Chapter is to provide an alternative procedure by which the City Council may provide for the payment of any part of the costs and expenses of maintaining and operating any public improvements which are local in nature, payable from annual benefit assessments apportioned among the several lots or parcels of property within the maintenance district established therefor .... "; and WHEREAS, convenience traffic signals are "public improvements" as set forth in Section 13.04.020 of the Bakersfield Municipal Code; and WHEREAS, signals currently being processed for installation should not be subject to the policy initiated by adoption of this resolution. WHEREAS, all future convenience traffic signals must be included in a maintenance district. -1- OF~G~AL NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The foregoing recitals are true and correct and incorporated herein. 2. Costs for operation and maintenance of future convenience traffic signals shall be collected through maintenance districts. 3. Said maintenance districts shall be established under Chapter 13.04 of the Bakersfield Municipal Code. 4. Costs assessed through the maintenance districts shall be assessed uniformly on all such districts on a per signal system basis. 5. Convenience traffic signal systems currently existing or being processed for approval by staff shall not be subject to this policy.
