Council Chambers, City Hall 1501 Truxtun Avenue, Bakersfield ROLl CALL Present: Absent: Mayor Price, Councilmembers McDermott, DeMond, Smith (seated at 5:20), Brunni, Rowles, Salvaggio Councilmember Edwards ACTION TAKEN HEARINGS Continued public hearing for review and discussion of the Disposition and Development Agreement with John Q. Hammons for the Bakersfield Convention Center Hotel Project. The following individuals spoke in support of the project: Graham Kaye-Eddie, Consultant; Jerry Stanners, President, Greater Bakers- field Chamber of Commerce read and submitted correspondence; Bruce Keith, representing the Downtown Business and Property Owners Association, read a written statement; Leroy Weygand, President, Kern County Tax Payers Association; Greg Whitney, President, Kern Economic Development Corporation; Terry Arnold, business owner; Ilo J. Scatena; Kelly Blanton, Kern County Superintendent of Schools, also sub- mitted written correspondence; and John Stovall. Pat Collins, Steve M. Nations, Charles Tolfree, Mitch Van Wormer, David Gay and Dean Gay, who also submitted a written statement, made comments and asked questions as a group. Dave Jones, President, John Q. Hammons Company, explained their intentions and thanked the DBA, KEDC, Chamber of Commerce and The Bakersfield Californian for their support. 133 Bakersfield, California, November 22, 1993 - Page 2 2. HEARINGS continued ACTION TAKEN Marvin Dean requested entering into a volunteer Memorandum of Understanding, which he submitted in writing. Brunni made comments and asked ques- tions of City Manager Tandy from his memo dated November 19, 1993: Was there a Feasibility Study done? #7 - Where are the ballroom and meeting rooms in the accounting costs? #8 - What would constitute the City initiating a cost overrun vs. Mr. Hammons initiating a cost overrun? If it were initiated by Mr. Hammons, would, and is there an inherent agree- ment that he or his organization pay? #14 - Is the corporate structure a part of the guarantee? #16 - (Government Code 65864) exactly are we talking about technical requirements? What are in the way #17 - Are we really going to be "under one roof" with the hotel or are we two separate properties? #25 - (Exhibit #9) Is essentially what we're doing in that 2.5 million dollar loan is a blank check with no check or balance? #27 - Please explain the $110,000 management fee now being kitchen equipment. In reference to a memo from Burke, Williams & Sorensen to Acting City Attorney Skousen - Does the Public Financing Authority have the same non-recourse status as the City and the DDA? City Manager Tandy stated that all questions will be addressed, in writing, prior to the December 15, 1993 meeting. Bakersfield, California, November 22, 1993 - Page 3 ~,~ 3.
