A RESOLUTION OPPOSING THE PROPOSED
FORMATION OF COUNTY SERVICE AREA NO. 85
(GENERALLY SOUTH OF THE 178 FREEWAY, EAST OF
OSWELL STREET AND NORTH OF COLLEGE AVENUE).
WHEREAS, a proposed formation of County Service Area No. 85 is within
the City of Bakersfield Sphere of Influence, generally located south of Freeway 178, east
of Oswell Street and north of College Avenue, has been filed with the Local Agency
Formation Commission pursuant to Title 5, Division 3, commencing with Section 56000
of the Government Code, to provide services to the area described in the formation
documents; and
WHEREAS, the Local Agency Formation has determined the area involved
is within the Sphere of Influence of the City of Bakersfield and has notified the City of
Bakersfield in writing, pursuant to Section 56841(h) of the Cortese-Knox Local
Government Reorganization Act of 1985, and Local Agency Formation Commission:
Procedures, Standards and Policies for the Evaluation of Proposals; and
WHEREAS, the LAFCO policy allows the City the first opportunity to
provide the service within our Sphere of Influence; and
WHEREAS, the proposed formation of County Service Area No. 85 is to
provide streetside landscaping and graffiti abatement; and
WHEREAS, the City be able to serve the area, upon annexation; and
WHEREAS, the City is concerned with needless expense to the property
owners; and
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield that the Council opposes the formation of County Service Area No. 85 and
declares and represents that the City of Bakersfield does intend to provide the service
proposed to be provided by the County Se~ice Area No. 85 subject to annexation of the
area to the City.
