RESOLUTION
A RESOLUTION ORDERING THE VACATION OF 26TH
STREET BETWEEN "H" STREET AND EYE STREET AND
THE ADJACENT ALLEY IN BLOCK 115 IN THE CITY OF
BAKERSFIELD.
WHEREAS, on Wednesday, September 28, 1994, the Council of the City of
Bakersfield, pursuant to the provisions of the "Public Streets, Highways and Service
Easements Vacation Law," being Chapter 3 of Part 3 of Division 9 of the Streets and
Highways Code of the State of California, passed and adopted its Resolution of Intention
No. 1125 declaring its intention to order the vacation of 26th Street between "H" Street and
Eye Street and the adjacent alley in Block 115 in the City of Bakersfield; and
WHEREAS, said Council did fix a time and place for hearing all persons
interested in or objecting to said proposed vacation, which hearing was held on Wednesday,
November 2, 1994, after notices were duly published and posted as required by law.
NOW, THEREFORE BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
1. The above recitals are true and correct and are incorporated herein.
2. 26th Street between "H" Street and Eye Street and the adjacent alley in Block 115
in the City of Bakersfield, County of Kern, State of California and more particularly
described as Parcel t That portion of public road right of way (82.5 feet in width) for 26th
Street, bounded westerly by the northerly prolongation of west line of Block 115 and
bounded easterly by a line parallel with the center line of Eye Street and 50 feet west of
said center line as measured at a right angle therefrom; as per "Map of the City of
Bakersfield", Kern County, California, filed November 25, 1898 in the office of the Kern
County Recorder and Parcel 2 All of the 20 foot wide alley in said Block 115 being bounded
by the south right of way line of 26th Street and the north right of way line of 25th Street,
both parcels of which are unnecessary for present or prospective street or alley purposes
and are hereby vacated, subject to the conditions enumerated herein.
3. A nonexclusive easement shall be reserved for public utilities purposes in, under,
over and upon the south 26 feet of above described Parcel 1 (26th Street) and the entire
alley area in above described Parcel 2 and the northerly prolongation of said alley to meet
the north right of way line of 26th Street.
4. An easement shall be reserved by the City of Bakersfield for public storm drain
purposes in, under and upon the south 15 feet of the north 33 feet of above described
Parcel 1 (26th Street).
5. All of or a portion of the reserved public storm drain easement (Item 4) within
said vacated street shall automatically terminate and be abandoned as an easement when
the applicant provides the following:

Relocation of the existing public storm drain line to City of Bakersfield
standards and acceptance; and
Dedication of an adequate easement for any relocated city storm drain
facilities extending through private property with alignment thereof
approved by the City.
6. The City Clerk shall certify to the passage of this Resolution and shall cause a
certified copy hereof, attested by the Clerk under the seal of the City, to be recorded in the
Office of the County Recorder of the County of Kern, California.

I HEREBY CERTIFY that the foregoing Resolution was passed and adopted
by the Council of the City of Bakersfield at a regular meeting thereof held on
