RESOLUTION ON THE APPEAL OF PORTER-
ROBERTSON ENGINEERING REPRESENTING FRANCO
PROPERTIES, UPHOLDING THE DECISION OF THE
ADVISORY AGENCY AND APPROVING PARCEL MAP
WAIVER 23-94.

WHEREAS, Parcel Map Waiver 23-94 is generally located on the east and
Verdugo Lane north of Noriega Road, as shown on attached Exhibit "A";
WHEREAS, in accordance with Bakersfield Municipal Code Section
16.12.030, and the California Government Code Section 66428(b), the City Engineer
acting as the Advisoxy Agency, made a finding that the filing of a Parcel Map would
serve no substantial purpose; and
WHEREAS, in accordance with Bakersfield Municipal Code Section
16.12.030(D), the Advisory Agency approved Parcel Map Waiver 23-94 subject to the
satisfaction of certain conditions; and
WHEREAS, within the time permitted by law, Porter-Robertson
Engineering, on behalf Franco Properties, filed an appeal in writing with the City
Council from the satisfaction of certain conditions imposed by the Advisory Agency; and
WHEREAS, a noticed public hearing was set before the Council on
November 2, 1994; and
WHEREAS, testimony was given by the applicant at said hearing.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield as follows:
1. The above-stated recitals, incorporated herein, are true and correct.
2. The proposed division of land, upon completion of the items
conditioned by the Advisory Agency, complies with such requirements as may have been
established by the Subdivision Map Act or local ordinance enacted pursuant thereto as
to area, improvement and design, floodwater drainage control, appropriate improved
public roads, sanitary disposal facilities, water supply availability, environmental
protection, and other requirements of the Subdivision Map Act or local ordinance
enacted pursuant thereto. (Required by Government Code 66428.(B))
3. The decision of the Advisory Agency is upheld, and Parcel Map
Waiver 23-94 is approved subject to the conditions attached hereto as Exhibit "B".
I HEREBY CERTIFY that the foregoing Resolution was passed and
adopted by the Council of the City of Bakersfield at a regular meeting thereof held on

Construct the north ½ of Noriega Road to City standards, including curb & gutter, street paving, and
minimum 5.5' wide sidewalk, from Verdugo Lane westerly to tie into existing road improvements.
Construct the west ½ of Verdugo Lane, including curb & gutter, street paving, and minimum 5.5' wide
sidewalk, from Noriega Road northerly to the school site.
Provide a current title report showing no delinquent taxes.
Verify the existence and location of the Calloway Canal.
Contact Jeff Bryson in the City Building Department (326-3720) to alleviate concerns relative to the
clearance from property lines to structures.
Designate this action as Parcel Map Waiver 23-94.
On Exhibit "B",
7.1 show adjacent record information, including a deed reference for the school site.
7.2 show existing monuments.
7.3 some of the numbers are not legible. Ensure all numbers and letters can be read, particularly
when the documents are microfilmed.
7.4 the maximum sheet size shah be 8V2" x 14". Ensure all letters and numbers will be legible for
recording purposes.
