AN ORDINANCE REPEALING SUBSECTION D OF SECTION
5.14.040 OF THE BAKERSFIELD MUNICIPAL CODE
RELATING TO EXPIRATION OF CABARET PERMITS.
WHEREAS, Subsection D of Section 5.14.040 of the Bakersfield Municipal Code
mandates that every cabaret permit shall expire annually on the thirty-first day of
December; and
WHEREAS, sending out notices and re-issuing permits on an annual basis is
extremely time-consuming and costly to the City; and
WHEREAS, the revocation provisions of the Chapter permit the City to revoke the
permit of any permit holder who is in violation of the terms or conditions pursuant to which
the permit has been issued, who interferes with the peace and quiet of the neighborhood,
or who is in violation of local, state or federal law; and
WHEREAS, the City therefore desires to repeal those provisions requiring the
annual expiration and re-application for cabaret permits.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of
Bakersfield as follows:
SECTION 1.
Subsection D of Section 5.14.040 of the Bakersfield Municipal Code, relating to the
annual expiration of cabaret permits, is hereby repealed.
SECTION 2.
This Ordinance shall be posted in accordance with the provisions of the Bakersfield
Municipal Code and shall become effective thirty (30) days from and after the passage.
