A RESOLUTION DETERMINING THAT THE SALE OF CERTAIN
CITY-OWNED REFUSE CARTS CURRENTLY IN PLACE ON
AUTOMATED REFUSE AND GREENWASTE COLLECTION
ROUTES CANNOT BE REASONABLY SOLD THROUGH THE
USUAL BIDDING PROCEDURES AND AUTHORIZING THE
FINANCE DIRECTOR TO DISPENSE WITH BIDDING THEREFORE
TO SELL SAID CARTS TO THE CONTRACTOR FOR A
NEGOTIATED AMOUNT OF $26,165.62.
WHEREAS, City annexed the Casa Loma area on July 10, 1997 and provided a
program for automated residential refuse and greenwaste collection; and
WHEREAS, City provided, at its own expense, refuse and greenwaste carts for said
program; and
WHEREAS, City entered into Agreement No. 96-63 on March 20, 1996 with Kern
Refuse Disposal, Inc. (Contractor), whereby Contractor shall furnish necessary refuse and
greenwaste cads for its service area; and
WHEREAS, City realigned route boundaries within said area, assigning 522 homes
to be serviced by Contractor; and
WHEREAS, both City and Contractor find it mutually agreeable and cost-effective for
Contractor to acquire said carts in automated collection program at a full purchase value; and
WHEREAS, the Finance Director recommends the Council find sale of said carts in
place cannot reasonably be obtained from more than one vendor as per the Public Works Director
recommendation and recommends the Council dispense with bidding under subsection D. 1. of
Section 3.20.060 of the Bakersfield Municipal Code.
NOW THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as
follows:
1. The above recitals are true and correct and incorporated herein by reference.
The carts cannot be reasonably sold other than in place to the Contractor
because of the cost of gathering and transporting the carts.
The Finance Director is authorized to dispense with bidding in accordance
with subsection D. 1. of Section 3.20.060 of the Bakersfield Municipal Code.
The sum of Twenty-five thousand, one hundred sixty-five dollars and sixty-two
cents ($25,165.62) for the sale of the carts will be collected by the Solid
Waste Enterprise Fund through a deduction in payment for other services to
the Contractor.

I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the Council
