I 6 2 ' 9 7 A RESOLUTION TO THE CA!,IFORNIA TRANSPORTATION COMMISSION DESIGNATING THE CITY OF BAKERSFIELD AS LEAD AGENCY IN THE~ CONSTRUCTION OF AN AMTRAK STATION ON THE BURLINGTON NORTHERN SANTA FE TRACKS, AND MAKING THE REQUIRED ASSURANCES TO THE CALIFORNIA TRANSPORTATION COMMISSION RELATED TO THE PROJECT. WHEREAS, at its meeting of October 22, 1997, the Council of the City of Bakersfield considered a request to the California Transportation Commission (hereafter referred to as "CTC") for the City of Bakersfield (hereafter referred to as "City") to be the lead agency in the construction of an Aretrak station on the Burlington Northern Santa Fe (BNSF) railroad tracks in Bakersfield, subject to completion of the CEQA process, and WHEREAS, the Council considered certain assurances to the CTC related to the project, which are required to be submitted to the CTC as part of its funding application process, NOW, THEREFORE BE IT RESOLVED by the Council of the City of Bakersfield as follows: Section 1. That the Council has considered the request to the CTC for permission to be lead agency in the construction of an Amtrak station on the BNSF railroad in Bakersfield, subject to completion of the CEQA process, and the Council hereby approves the submittal of said request. Section 2. That the Council has considered certain assurances to the CTC related to the project, which are required to be submitted to the CTC as part of its funding application process, and the Council hereby makes the following assurances: The City will provide all environmental documemation required by the CTC for project approval. B. Public fixed-route transit will be available to the facility. C. The City will provide for security at the facility. The City agrees to own the station and maintain the station at City expense, and not charge Amtrak rent except for utilities. The City intends to use existing local transportation funding for regular operation and maintenance costs. In addition, the City will apply for any available funding from the State for major maintenance expenses as they arise. The City has the financial and institutional ability to implement the project and is empowered to: let a contract; to sue or be sued by another entity or person; and to carry out its other responsibilities and duties. This project will be available to the general public, or its primary purpose will be to benefit the public and does not benefit a private entity or individual. The matching funds required for said project are available and committed to this project. If the project exceeds available State funds, the City will provide the additional local funds needed to complete the project, or the project will be reduced in scope. The City will comply with the CTC's Hazardous Waste Identifications and Clean-up Policy for Rail Right-of-Way: This project will be fully investigated by the City to determine the absence/presence of hazardous wastes. The City will take reasonable steps to assure full due diligence, clean-up of the site, as appropriate, as well as not seeking State funds for clean-up, damage or liability costs associated with hazardous wastes. The City will comply with the CTC's Timely Use of Funds Policies. No other capital funds previously programmed, planned or approved for rail purposes will be used for other than rail purposes, The proposed project has no unnecessary enhancements and is not an unnecessarily elaborate alternative. Unless otherwise specified in Proposition 116, the City states that new or increased development fees, taxes or exactions, or permit fees will not be included in the operating budget of this project or for the purpose of matching funds for Proposition 116 grants. An Amtrak passenger safety program will be put in place. O. The agency shall comply with the State and federal accessibility requirements for the Section 3. BE IT FURTHER RESOLVED that the City Manager or his authorized designated City officials are hereby authorized to execute any and all pertinent documents in relation to this request on behalf of the City of Bakersfield. Section 4. The City Clerk shall certify to the adoption of this Resolution and send a certified copy to: State of California Business, Transportation and Housing Agency Department of Transportation Design and Local Programs 1120 N Street Sacramento, CA 94274-0001 ........ 000 ..........
