BOND ACT FOR THE CONSTRUCTION AND ACQUISITION
OF IMPROVEMENTS

IT IS HEREBY RESOLVED BY THE CITY COUNCIL (the "Council")
OF THE CITY OF BAKERSFIELD as follows:
WHEREAS, all of the owners of more than 60 percent in
area of the property subject to assessment therefor have signed and
filed with the City Clerk of the city of Bakersfield a written
petition for the improvements meeting the requirements of Section
2804.5 of the Streets and Highways Code of the State of California,
as applicable, and for undertaking proceedings pursuant to special
assessment and assessment bond acts, and to assess the costs
thereof upon the properties benefitted, and waiving proceedings
under Division 4 of the Streets and Highways Code, for the
construction and acquisition of improvements set forth in
Exhibit "A" attached hereto and by reference incorporated herein;
and
WHEREAS, the costs and expenses of the contemplated
improvements are to be chargeable upon an assessment district, the
exterior boundaries of which are the coterminous exterior
boundaries of the composite and consolidated area shown on the map
thereof on file in the office of the City Clerk, to which reference
is hereby made for further particulars; and
WHEREAS, the public interest and convenience will be
served by the taking of such proceedings;
THEREFORE, THE COUNCIL FINDS, DETERMINES AND ORDERS AS
FOLLOWS:
1. That all of the owners of more than 60 percent in
area of the property subject to assessment for the construction and
acquisition of improvements described in Exhibit "A" have signed
and filed with the city Clerk of this City a written petition for
the construction and acquisition of improvements pursuant to
appropriate special assessment and assessment bond acts, without
further compliance with the provisions of Division 4 of the Streets
and Highways Code.
2. That proceedings for the construction and

acquisition of such improvements shall be had pursuant to the
Municipal Improvement Act of 1913 and the bonds upon the unpaid
assessments thereof shall be issued pursuant to the Improvement
Bond Act of 1915.
3. That the provisions of Division 4 of the Streets and
Highways Code be, and they are hereby, dispensed with.
I HEREBY CERTIFY that the foregoing Resolution was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on September 8, 1993, by the following vote:

Bakersfield, California, described more fully as follows:
Parcels 2, 3, and 4 of Parcel Map 6868 in the City of
Bakersfield recorded July 6, 1984, in Book 31 of Parcel
Maps at page 23 on file in the office of the Kern County
Recorder, State of California.

follows:
1. That I am the City official to whom the petition in
the above assessment district was referred for checking;
2. That I have computed the areas represented by the
petition filed with the city Clerk of the City of Bakersfield;
3. That the petition is signed by all of the owners of
more than 60 percent in area of the property subject to assessment
for the proposed improvements, as such owners appear on the
Assessor's ownership roll for the County of Kern as of the day that
the petition was filed or, in the case of transfers of land or
parts thereof subsequent to the date upon which the last Assessor's
roll was prepared, as such owners appear on the records in the
County Assessor's office which the County Assessor will use to
prepare the next Assessor's roll;
4. That if the petition has been signed by an owner of
more than 40 percent in area of the property to be assessed then
the petition has also been signed by owners of more than 50 percent
of the remaining property to be assessed, pursuant to the
requirements of Section 2804.3 of the California Streets and
Highways Code;
5. That where the person signing the petition appears
on the County Assessor's roll as the owner of property as joint
tenant or tenant in common, or as husband or wife, the property was
counted as if all such persons duly signed; and
6. That pursuant to subdivision (a) (3) of Section 2804
of the California Streets and Highways Code, the petition is
sufficient for the purpose of forming an assessment district.
