A RESOLUTION REGARDING A REQUEST BY THE
LOCAL AGENCY FORMATION COMMISSION TO TAKE
LEGISLATIVE ACTION ON THE PROPOSED
ANNEXATION NO. 7 TO COUNTY SERVICE AREA NO. 27
(SOUTH OF TAFF HWY. EAST OF WIBLE ROAD
PUMPKIN CENTER AREA).
WHEREAS, a proposal for the Annexation No. 7 to the County Service
Area No. 27 and formation of Zone of Benefit No. 2 within the City of Bakersfield
Sphere of Influence, located south of Taft Hwy., east of Wible Road Pumpkin Center
area, has been filed with the Local Agency Formation Commission pursuant to Title 5,
Division 3, commencing with Section 56000 of the Government Code, to provide services
to the area described in the formation documents; and
WHEREAS, the Local Agency Formation Commission has determined the
area involved is within the Sphere of Influence of the City of Bakersfield and has
notified the City of Bakersfield in writing, pursuant to Section 56841(H) of the Cortese-
Knox Local Government Reorganization Act of 1985, and Local Agency Formation
Commission: Procedures, Standards and Policies for the Evaluation of Proposals; and
WHEREAS, the services provided will be street lighting, dry sewer
maintenance and septic monitor and drainage maintenance; and
WHEREAS, Annexation #7 to County Service Area #27 encourage
leapfrog discontiguous development; and
WHEREAS, Annexation #7 to County Service Area #27 promotes urban
sprawl; and
WHEREAS, Annexation #7 to County Service Area #27 is not consistent
with the Metropolitan Bakersfield 2010 General Plan that was adopted by the City and
County; and
WHEREAS, Annexation #7 to County Service Area #27 provides
inefficient delivery of services; and
WHEREAS, there will be a potential ground water contamination in the
general area.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield that the City of Bakersfield does oppose the proposed Annexation #7 to
County Service Area #27.
