RESOLUTION NO.
A RESOLUTION REGARDING A REQUEST BY THE
LOCAL AGENCY FORMATION COMMISSION TO TAKE
LEGISLATIVE ACTION ON THE PROPOSED
FORMATION OF COUNTY SERVICE AREA NO. 81
(NORTH OF OLIVE DRIVE TO NORRIS ROAD
BETWEEN MOHAWK AND FREEWAY 99).
WHEREAS, a proposal for the formation of County Service Area No. 81
within the City of Bakersfield Sphere of Influence, located north of Olive Drive to
Norris Road between Mohawk and Freeway 99, has been filed with the Local Agency
Formation Commission pursuant to Title 5, Division 3, commencing with Section 56000
of the Government Code, to provide services to the area described in the formation
documents; and
WHEREAS, the Local Agency Formation Commission has determined the
area involved is within the Sphere of Influence of the City of Bakersfield and has
notified the City of Bakersfield in writing, pursuant to Section 56841(H) of the Cortese-
Knox Local Government Reorganization Act of 1985, and Local Agency Formation
Commission: Procedures, Standards and Policies for the Evaluation of Proposals; and
WHEREAS, the service to be provided will be street sweeping; and
WHEREAS, the proposed formation of County Service Areas encourage
leapfrog discontiguous development; and
WHEREAS, the proposed formation of County Service Area #81 provides
for the inefficient delivery of services; and
WHEREAS, the proposed formation of County Service Area #81 is not
consistent with the Metropolitan Bakersfield 2010 General Plan that was adopted by the
County and the City.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield that the City of Bakersfield does oppose the proposed County Service Area
#81.
