RESOLUTION DENYING A MODIFICATION TO ALLOW A 5 1/2
FOOT HIGH FENCE WITHIN THE FRONT YARD SETBACK
WHERE 4 FEET IS THE MAXIMUM PERMITFED IN AN R-1 (ONE
FAMILY DWELLING) ZONE ON THAT CERTAIN PROPERTY
COMMONLY KNOWN AS 3608 GINNELLI WAY.
WHEREAS, Adnan Al-Qudsi, desires a modification to Section 17.08.180B of the
Bakersfield Municipal Code, to allow a 5 1/2 foot high fence in the front yard area
where 4 feet is the maximum is permitted; and
WHEREAS, at a noticed public hearing held on September 28, 1993, the
application was duly heard and considered and the Board of Zoning Adjustment, by its
Resolution No. 58-93, denied the requested modification; and
WHEREAS, within the time prescribed by law, ADNAN AL-QUDSI filed an
appeal in writing with the Council of the City of Bakersfield appealing the denial of the
modification; and
WHEREAS, a notice was duly given as provided in Title Seventeen of the
Bakersfield Municipal Code setting the time and place for a public hearing before this
Council on said appeal, which public hearing was held before the Council of the City of
Bakersfield on December 10, 1993.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield that, based upon the record of proceeding before the Board of Zoning
Adjustment and the proceeding before and findings of this Council, the appeal of
ADNAN AL-QUDSI from the decision of the Board of Zoning Adjustment is hereby
denied; and be it further resolved.
