RESOLUTION DETERMINING THAT AN AIR
CONDITIONING COOLING TOW~K CANNOT BE
REASONABLY OBTAINED THROUGH USUAL BIDDING
PROCEDURES; AUTHORIZING THE FINANCE DIRECTOR
TO DISPENSE WITH BIDDING TB~K~FOR, NOT TO
EXCEED $35,000; AND AUTHORIZING AN
APPROPRIATION IN THAT AMOUNT FROM 'x~ COUNCIL
CONTINGENCY FUND.
WHEREAS, the Bakersfield Police Department air
conditioning cooling tower has deteriorated to the point that it
has to be replaced in the very near future; and
WHEREAS, the 20-year-old tower was inspected by its
manufacturer, Baltimore Aircoil, and by PG&E, and it was determined
that it would not be economically feasible to repair the tower; and
WHEREAS, a replacement cooling tower from Baltimore
Aircoil is eligible for rebate under a rebate plan offered by PG&E;
and
WHEREAS, only the Baltimore Aircoil cooling tower can be
installed as a part of the current air conditioning system; and
WHEREAS, a replacement cooling tower from Baltimore
Aircoil will cost approximately $19,977 plus tax, plus an
installation fee of approximately $11,000; and
W"nmKF~%S, PG&E has indicated that it will rebate
approximately $14,916 for the installation of the replacement
cooling tower and also estimates that there will be an annual
energy savings of approximately $4,950; and
WHEREAS, the Finance Director has determined, and has
recommended that this Council find, that the purchase of an air
conditioning cooling tower for the Bakersfield Police Department
can only be reasonably obtained from one vendor (Baltimore Aircoil)
because of the necessity to successfully integrate such equipment
into the existing air conditioning system, and has recommended that
this Council authorize dispensing with bidding requirements in
accordance with Section 3.20.060 D of the Bakersfield Municipal
Code.
NOW, THEREFORE, BE IT RESOLVEDby the Council of the City
of Bakersfield as follows:
1. The Council hereby finds that the purchase of an air
conditioning cooling tower for the Bakersfield Police Department
can only be reasonably obtained from one vendor (Baltimore Aircoil)
because of the necessity to successfully integrate such equipment
into the existing air conditioning system, and has recommended that
this Council authorize dispensing with bidding requirements in

accordance with Section 3.20.060 D of the Bakersfield Municipal
Code.
2. The Council hereby authorizes appropriation from the
Council contingency fund in an amount not to exceed $35,000 to be
transferred to the Public Works capital improvement budget for the
purchase and installation of an air conditioning cooling tower
provided by Baltimore Aircoil.
