HomeMy WebLinkAboutRES NO 195-93RESOLUTION NO. ~ 9~-.9 ~ RESOLUTION ADOPTING THE NORTHEAST BAKERSFIELD PLANNED SEWER AREA AND MAKING FINDINGS RELATIVE THERETO. WHEREAS, pursuant to Section Government Code, this Council is, upon findings, authorized to adopt sewer neighborhood sewer areas; and WHEREAS, Assessment District No. 93-1 66483 of the California the making of specified plans for local and (A.D. 93-1 and Assessment District No. 86-1 (A.D. 86-1) have formed to fund sewer facilities; and WHEREAS, the Council desires to create the Northeast Bakersfield Planned Sewer Area (NBPSA), the boundaries of which encompass A.D. 93-1, A.D. 86-1, as well as land in neither assessment district; and WHEREAS, certain properties within NBPSA and A.D. 93-1 are currently subject to the Williamson Act and have been assessed under A.D 93-1 according to current State law at lower rates than they would have been assessed had they not been under the Williamson Act; and WHEREAS, certain properties within NBPSA and A.D. 93-1 are within unincorporated territory and have been assessed according to County Resolution No. 93-258 at lower rates than they would have been assessed in consideration for the County granting O~IGIA)AL the City jurisdiction to levy assessments within unincorporated territory under A.D. 93-1; and WHEREAS, certain property within NBPSA and A.D. 93-1 is within incorporated territory and has been assessed at a lower rate than it would have been assessed due to the current use of the property(softball diamonds and related facilities); and WHEREAS, certain properties within NBPSA but outside of A.D. 93-1 are within A.D. 86-1 and have not been assessed under A.D. 93-1, but upon connection to sewer facilities within A.D. 93-1 shall pay their proportionate share for use of said facilities as per the attached fee schedule; and WHEREAS, certain properties within NBPSA but outside of A.D. 93-1 and A.D. 86-1 (both incorporated and unincorporated properties) have not been assessed under A.D. 93-1, but upon connection to sewer facilities within A.D. 93-1 shall pay their proportionate share for use of said facilities as per the attached fee schedule; and WHEREAS, prior to approval of any development entitlement as defined in Bakersfield Municipal Code section 16.32.060 E as to any of the above referenced properties, said properties shall be reassessed or shall reimburse their fair share of benefits provided by A.D. 93-1. 93-1 and the proceeds shall be fairly apportioned to A.D. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The foregoing recitals are true and correct and 2 incorporated herein. 2.The Council hereby finds that, as to the Northeast Bakersfield Planned Sewer Area, as described in the plans (on file in the Public Works office), map and fee schedules attached hereto and incorporated herein by reference, subdivision and development of property within such area will require construction of sewer facilities, described in such plan, and that the fees provided are fairly apportioned either on the basis of benefits conferred on property for subdivision or on the need for such facilities created by the proposed subdivision and development of other property within such area. 3. The Northeast Bakersfield Planned Sewer Area Plan is hereby adopted. .......... o0o .......... THE REIMBURSEMENT SHALL GO WITH THE LAND AND WILL BENEFIT THE CURRENTOWNERS OF PARCELS AT THE TIME OF REIMBURSEMENT. NOTE 4 THE REIMBURSEMENT OF DEFERRED ASSESSMENT DEPICTED FOR EACH PARCEL NUMBER APPEARS AT YEAR '0~ AND IS REFERENCED IN THE ENGINEER'S REPORT, EXHIBIT G, FOR ASSESSMENT DISTRICT NO 93-1, NORTHEAST BAKERSFIELD SEWER. NOTE 5 ANY PARCEL WHICH DEVELOPS TO A GREATER DENSITY THAN THAT WHICH IT WAS ASSESSED FOR ACCORDING TO THE FINAL ENGINEER'S REPORT FOR A.D. 93-1, SHALL PAY THE DIFFERENC~ BASED ON THE EQUIVALENT DWELLING UNIT VALUE ESTABLISHED IN THE COLUMN DESIGNATED "OUTSIDE PARCEL COST'.
