RESOLUTION MAKING FINDINGS AND ADOPTING THE
CAPITAL IMPROVEMENT PLAN FOR THE METROPOLITAN
BAKERSFIELD HABITAT CONSERVATION PLAN.
WHEREAS, pursuant to Government Code Section 66000 et. seq., a capital
improvement plan is required to levy fees associated with the Metropolitan Bakersfield
Habitat Conservation Plan (MBHCP);
and
WHEREAS, the MBHCP and Implementation/Management Agreement
(Agreement No. 93-~_69 ) dated July, 1993 indicate the approximate location, size, time
of availability, and estimates of cost for all facilities and improvements to be financed
with the fees;
and
WHEREAS, a public hearing before the City Council was advertised and
held August 25, 1993, to consider input on adoption of the MBHCP Capital
Improvement Plan;
and
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield that the MBHCP and Implementation/Management Agreement (Agreement
No. 93-169) dated July, 1993 are hereby approved and adopted as the Capital
Improvement Plan for fees levied under the MBHCP Program.
I HEREBY CERTIFY that the foregoing Resolution was passed and
adopted by the Council of the City of Bakersfield at a regular meeting thereof held
