HomeMy WebLinkAboutRES NO 105-93 RESOLUTION NO. 'l 0 .5 - 9 3 A RESOLUTION ADOPTING THE 1993-1994 TRANSPORTATION I~PACT FEE SC~w.,~-~E. WHEREAS, Ordinance No. 3513 amended the Transportation Impact Fee program for new development which was adopted in order for new development to bear a proportionate share of the cost of new or expanded transportation facilities required by such development; and W~E/~EAS, Ordinance No. 3513 requires that the City Council annually adopt a fee schedule; such schedule provides partial funding for the transportation facilities included in the Regional Transportation Facilities List; and .W~3~EAS, a public hearing before the City Council was duly advertised and held on June 23, 1993; and W~RWI~AS, the City Council has considered and made the following findings: 1. The fee schedule, as depicted in Exhibit "A" attached hereto and incorporated as though fully set forth herein, is for the sole purpose of funding transportation facilities included in the Regional Transportation Facilities List. 2. There is a reasonable nexus between the fee's use and the type of development projects on which the fee will be imposed because the fee is calculated in relationship to the trip generation potential of that development and that development's impact on the regional transportation system. 3. There is a reasonable nexus between the need for a regional transportation system and the types of development projects on which the fee is imposed because all residential, commercial and industrial projects do, to a measurable degree, increase the need for a regional transportation system. 4. There is a reasonable nexus between the amount of the fee and the cost necessary to provide a regional transportation system as depicted on the Metropolitan Bakersfield 2010 General Plan. NOW, THEREFORE, BE IT RESOL~uby the Council of the City of Bakersfield that the fee schedule set forth as Exhibit "A" attached hereto and incorporated as though fully set forth herein is hereby approved and adopted. .......... o0o ..........
