HomeMy WebLinkAboutRES NO 25-93RESOLUTION NO. 25-93 A RESOLUTION OF APPLICATION PROPOSING PROCEEDINGS FOR ANNEXATION OF TERRITORY TO THE ClTY OF BAKERSFIELD IDENTIFIED AS ANNEXATION NO. 373, COFFEE ROAD NO. 1 ANNEXATION (WARD 4). WHEREAS, the City of Bakersfield desires to propose a change of organization, to wit, the annexation to the City of Bakersfield of the hereinafter- described territory, pursuant to Section 56800 of the Government Code of the State of California; and WHEREAS, the territory proposed for annexation is the right-of-way for Coffee Road; and WHEREAS, the City of Bakersfield does not zone the rights-of-way of public roads. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield that it hereby finds and determines as follows: 1. That the City of Bakersfield hereby proposes the annexation to the City of Bakersfield of the territory described in Exhibit "A" and shown on map marked Exhibit "B", attached hereto and made a part of this resolution as though fully set forth herein. 2. That a plan for providing services within the affected territory of the proposed annexation, in accordance with the provisions of Section 56653 of the Government Code, is marked as Exhibit "C", attached hereto and made a part hereof as though fully set forth herein. 3. That this proposal for change of organization, to wit, annexation, is made pursuant to the Cortese-Knox Local Government Reorganization Act of 1985, and it is requested that proceedings be authorized for annexation in accordance therewith. 4. That the reasons for the proposed change of organization are that the area is a right-of-way with landscaped area maintained by the City of Bakersfield to the benefit of property owners within the City of Bakersfield and that the City of Bakersfield, as owner of the balance of the affected territory, desires to have such City- owned property converted to tax exempt status. OFII(~IN~L 5. It has been determined that this project is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15319(a). 6. That the territory proposed for annexation as described herein has been determined to be uninhabited pursuant to the Cortese-Knox Local Government Reorganization Act of 1985, Section 56046 of the Government Code. 7. PARKS AND RECREATION-N/A-territory is totally comprised of public roadway and canal right of way. LIBRARY-N/A Constmction/Maintenance:Sweenine:Li~htine: The City Corporation yard on Truxtun Avenue, west of Freeway 99 will provide necessary facilities, personnel and sendces to accommodate Public Works efforts. Maintenance and personnel will be dispa~hed from the City Yard on a regular basis for preventative maintenance as needed. Repair includes streets, constructed/maintenance, sweeping and lighting. SK'~R-N/A WA'i'ER-This area will be serviced by C. aiifomia Water Service Company. O'fHER-(Refuse)-N/A 24 hour patrol is provided in the immediate vicinity of this annexation. First priority response is approximately 7.00 minutes or less. Fire protection is provided on a 24-hour basis and the annexation will not affect City/county Joint Fire service capability or response time. N/A N/A There will be no reduction in the range capacity of the City to ~rovide the necessary public work services to this area. Sendces will be on a regular basis and "as needed". The annexation of this territory will not affect the near term level or capability of the City to provide needed services. The recent construction of Coffee Road from Rosedale northerly will increase the maintenance respons~ility of the City but will not affect the existing level of service. IV. Would city/district require any upgrading or change in facilities to serve affected territory (roads, fire hydrants, mains, etc.)?: If so, would city/district or residents be respons~le for f'mancing? No upgrading or change in facilities will be required in the territory for annexation. City operated maintenance District No. 1-1 will continue to maintain the existing landscaping along Coffee Road within the annexation area. The City will also continue to contribute a percentage of the maintenance cost of the state maintained traffic signal system at Rosedale Highway and Coffee Road. Indicate and explain existing zoning in affected territory. N/A - The territory consists of federally owned land for the Friant Kern Canal right of way and public road right of way for Coffee Road and has no designated zoning. Indicate and explain proposed prezoning in area. (List effects on present land use that would occur as a result of annexation such as maintenance of livestock on property, etc.) N/A - The territory will not be subject to prezoning because it will remain as canal right of way and public road right of way an will not have a zoning designation. -3- ORIGINAL VII. N/A - Territory has tax exempt status being federally owned land for canal use and public road right of way. Would affected area be subject to any bonded indebtedness of the city/district: If so, explain. No. - Tax exempt status of territory will not change and the area will not be levied for City bonded indebtedness.
