A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF B~KERSFIELD, ORDERING CHANGE AND
MODIFICATION TO aSSESSMENT DISTRICT NO. 87-1
RESOLVED, BY THE CITY COUNCIL (the "Council") OF THE CITY
OF BAKERSFIELD (the "City"), as follows:
WHEREAS, on December 9, 1992, the Council did adopt its
Resolution of Intention No. 1097 proposing a change and
modification to the City of Bakersfield Assessment District No. 87-
1 (the "District"), such change and modification having been set
forth in an amended engineer's report for the District (the
"Amended Report"), an amended assessment roll for the District (the
"Amended Assessment"), an amended boundary map of the District (the
"Amended Map") and an amended assessment diagram of the District
(the "Amended Diagram"), each having been filed with the City
Clerk; and
WHEREAS, pursuant to Section 10351, et seq., of the
California Streets and Highways Code (the "Act"), the Council
appointed January 20, 1993, at the hour of 7:00 p.m., in the
regular meeting place of the Council, being the Council Chambers,
Bakersfield City Hall, 1501 Truxtun Avenue, Bakersfield,
California, as the time and place for hearing objections to the
proposed change and modification, and directed the City Clerk to
give notice of said hearing as required by the Act; and
WHEREAS, it appears that notice of the hearing was duly
and regularly published and mailed in the time, form and manner
required by the Act, as evidenced by the affidavits and
certificates on file with the City Clerk; and
WHEREAS, the hearing was duly and regularly held by the
Council at the time and place designated in the notice; and
WHEREAS, the Council did hear all objections to the
change and modification set forth in the Amended Report, Amended
Assessment, Amended Map and Amended Diagram, and all persons
interested and desiring to be heard were given an opportunity to be
heard, and all matters and things pertaining to the change and
modification were fully heard and considered by the Council and the
Council has acquired jurisdiction to order the change and
modification to the District.

NOW, THEREFORE, BE IT FOUND, DETERMINED AND ORDERED AS
FOLLOWS:
1. The foregoing determinations are hereby incorporated
herein and made a part of this resolution and shall be deemed final
and conclusive.
2. The Amended Report, Amended Assessment, Amended Map
and Amended Diagram (collectively, the "Amendments") are hereby
finally approved, and the Amendments shall supersede their
respective counterparts originally adopted and approved in
connection with the District, and, shall stand as the current and
final engineer's report, assessment roll, boundary map and
assessment diagram for the District from this date forward.
3. The change and modification to the District as set
forth in the Amendments is hereby approved and ordered.
4. The City Clerk shall record the Amended Diagram with
the Kern County Recorder and shall execute and cause a Notice of
Amended Assessment, with the amended assessment roll attached, to
be recorded with the Kern County Recorder, in the manner and form
prescribed by law. The City Clerk shall further cause a certified
copy of the recorded Amended Diagram and recorded Amended
Assessment to be filed in her office.

I HEREBY CERTIFY that the foregoing Resolution was passed
and adopted by the City Council of the City of Bakersfield at a
regular meeting thereof held on the 20th day of January 1993, by
the following vote:
