A RESOLUTION AUT~ORI ZING THE
DONATION OF SEIZED FIREAI~S TO THE
UNITED STATES AIR FORCE.
WHEREAS, the Bakersfield Police Department currently
possesses a number of firearms, described in the attached Exhibit
"A," which have been seized pursuant to state law; and
WHEREAS, these firearms were originally earmarked for the
Bakersfield Special Weapons and Tactics (SWAT) team; and
WHEREAS, the SWAT team has determined that it has no use
for these weapons; and
WHEREAS, the United States Air Force at Edwards Air Force
Base is currently in the process of outfitting its SWAT team and
has indicated that it could utilize these weapons for outfitting
and training the team; and
WHEREAS, Section 12030 of the California Penal Code
permits any officer having custody of any firearms which may be
useful to any military agency of the federal government, upon the
authority of the City Council and the approval of the Adjutant
General, to deliver the firearms to the commanding officer of a
unit of the military agency.
NOW, T~RE, BE IT RESOL¥~Dby the Council of the City
of Bakersfield as follows:
1. The foregoing recitals are true and correct and
incorporated as though fully set forth herein.
2. The City of Bakersfield hereby donates the firearms
set forth in Exhibit "A" to the United States Air Force.
3. The chief of police may deliver said firearms to the
commanding officer of a unit of the United States Air Force at
Edwards Air Force Base.
4. Upon delivery of said firearms, the chief of police
shall obtain a receipt for the firearms and shall keep the receipt
on file in his office as a public record.

I HEREBY CERTIFY that the foregoing Resolution was passed
