HomeMy WebLinkAboutRES NO 219-92RESOLUTION NO. 219-92 A RESOLUTION MAKING FINDINGS, APPROVING NEGATIVE DECLARATION AND ADOPTING SEGMENT VIII OF PROPOSED AMENDMENT TO THE LAND USE ELEMENT OF THE METROPOLITAN BAKERSFIELD 2010 GENERAL PLAN (LAND USE ELEMENT AMENDMENT 3-92). WHEREAS, the Planning Commission of the City of Bakersfield, in accordance with the provisions of Section 65353 of the Government Code, held a public hearing on THURSDAY, NOVEMBER 18, 1992, on Segment VIII of a proposed amendment to the Land Use Element of the General Plan, notice of the time and place of hearing having been given at least twenty-one (21) calendar days before said hearing by publication in the Bakersfield Californian, a local newspaper of general circulation; and WHEREAS, such Segment VIII of the proposed amendment to the Land Use Element of Metropolitan Bakersfield 2010 General Plan is as follows: SEGMENT VIII: PORTER-ROBERTSON ENGINEERING has applied to amend the Land Use Element of the Metropolitan Bakersfield 2010 General Plan consisting of a change to the Master Equestrian Trail System in the Polo Grounds area by eliminating the equestrian portion and developing an eight- foot wide meandering sidewalk within the existing easement. Therefore, this proposal would increase the amount of landscaping within the easement. and WHEREAS, for the above-described Segment, it was determined that the proposed project is exempt from the provisions of the California Environmental Quality Act (CEQA), pursuant to Section 15301(C); and WHEREAS, the separation of the Commercial driveways and the equestrian trail was originally necessary to reduce potential traffic/horse conflicts; and WHEREAS, the City Council considered the significant changes to the original Polo Grounds concept which included a 50-acre equestrian facility which has been subsequently deleted at the request of the original developer; and OR(GfNAL WHEREAS, the City Council did acknowledge the need to retain some of the original equestrian trail system to maintain regional equestrian circulation for the Rosedale area; and WHEREAS, the City Council did consider testimony of those persons who are required to pay maintenance costs for the extensive equestrian trail system and those persons in the area who were relying on equestrian access through this area; and WHEREAS, by Resolution No. 55-92 on September 17, 1992, the Planning Commission recommended denial of Segment VIII and this Council has fully considered the findings made by the Planning Commission as set forth in that Resolution; and WHEREAS, the Council of the City of Bakersfield, in accordance with the provisions of Section 65355 of the Government Code, conducted and held a public hearing on WEDNESDAY, NOVEMBER 18, 1992, on the above described Segment VIII of the proposed amendment to the Land Use Element of the Metropolitan Bakersfield 2010 General Plan, notice of time and place of the hearing having been given at least ten (10) calendar days before the hearing by publication in the Bakersfield Californian, a local newspaper of general circulation; and findings: WHEREAS, the Council has considered and hereby makes the following 1. All required public notices have been given. 2. The provisions of CEQA have been followed. 3. The proposed General Plan Amendment will not have any possibility to cause a significant adverse effect on the environment as it is a minor change to improvements within an adopted trail easement. 4. The proposed General Plan Amendment will be compatible with existing and future development in surrounding areas and the project area. 5. The City Council decision provides both a system of trails more useable by the residents of the Polo Grounds and provide regional equestrian linkage between existing equestrian areas, as shown in Exhibit "B". 6. The trail system in locations designated Commercial is hereby modified as shown in Exhibit "B" to run along the adjacent street right-of-way and not off-street or "behind" the Commercial areas except as shown, since that separation was only necessary to move equestrian usage away from Commercial drive approaches. ORIG(NAL NOW, THEREFORE, BE IT RESOLVED and found by the Council of the City of Bakersfield as follows: 1. The above recitals and findings, incorporated herein, are true and correct. 2. The report of the Planning Commission, including maps and all reports and papers relevant thereto, transmitted by the Secretary of the Planning Commission to the City Council, is hereby received, accepted and approved. 3. The City Council hereby approves and adopts Segment VIII of the proposed amendment to the Land Use Element of the Metropolitan Bakersfield 2010 General Plan, constituting changes as shown on the maps marked Exhibit "A", "B" & "C" attached hereto and incorporated as though fully set forth, for property generally located south of Snow Road, north of Hageman Road, generally west of Calloway Drive, subject to the following condition of approval: It shall be required as a deed restriction on all final maps filed after November 18, 1992, which are adjacent to that portion of the trail permitting equestrian use, that language be added which clearly states that these properties are subject to the adopted trail system intended for equestrian use of the Polo Grounds development. 4. That Segment VIII, approved herein, be combined with other approved segments described in separate resolutions, to form a single Land Use Element Amendment, GPA 3-92.
