HomeMy WebLinkAboutRES NO 208-92RESOLUTION RESOLUTION ADOPTING THE HOSKING PLANNED SEWER AREA AND MAKING FINDINGS RELATIVE THERETO. WHEREAS, pursuant Government Code, this Council is, findings, authorized to adopt neighborhood sewer areas; and WHEREAS, the Council Planned Sewer Area; and currently to Section 66483 of the California upon the making of specified sewer plans for local and desires to create the Hosking WHEREAS, certain properties within said area are subject to the Williamson Act and have been assessed of 1. The incorporated herein. according to current State law at lower rates than they would have been assessed had they not been under the Williamson Act; and WHEREAS, upon termination of the Williamson Act Contract, as to any such property and further upon change in any development entitlement (as defined in Bakersfield Municipal Code Section 16.32.060) as ~o. that property, said property shall be reassessed its fair share of benefits provided by the Hosking Trunk Sewer Assessment District and the proceeds shall be fairly apportioned to the Assessment District. NOW, THEREFORE, BE IT RESOLVED by the Council of the City Bakersfield as follows: foregoing recitals are true and correct and 2. The Council hereby finds that, as to the Hosking Planned Sewer Area, as described in plans and maps therefore attached hereto and incorporated herein by reference, subdivision and development of property within such area will require construction of facilities, described in such plan, and that the fees provided are fairly apportioned either on the basis of benefits conferred on property for subdivision or on the need for such facilities created by the proposed subdivision and development of other property within such area. 3. THE REIMBURSEMENT OF DEFERRED ASSESSMENT DEPICTED FOR EACft PARCEL NUMBER UNDER TIlE WILLIAMSON ACT APPEARS AT YEAR "0' AND IS REFERENCED IN TIlE ENGINEER'S REPORT, EXltIBIT B, '1 ABLE B IV FOR ASSESSMENT DISTRICT NO 91-1, HOSKING TRUNK SEWER. WILLIAMSON ACT PARCELS SltALL BE REQUIRED TO REIMBURSE THE APPROPRIATE FEE AS INDICATED IN THE ABOVE SCHEDULE AT TltE TIME OF A ZONE CHANGE OR ANY OTItER CHANGE OF DEVELOPMENT ENTITLEMENTS.
