HomeMy WebLinkAboutRES NO 198-92RESOLUTION NO. ~.98-92 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD ORDERING THE VACATION OF THE NORTH/SOUTH ALLEY CONNECTING BERNARD STREET TO JEFFERSON STREET, BETWEEN ALTA VISTA DRIVE AND INYO STREET (BLOCK 7 OF ALTA VISTA TRACT), IN THE CITY OF BAKERSFIELD WHEREAS, Planning Commission, on August 20, 1992, considered a request for vacation of the 25 foot wide north/south alley connecting Bernard Street to Jefferson Street, between Alta Vista Drive and Inyo Street (Block 7 of Alta Vista Tract), and pursuant to Government Code Section 65402 did make a finding of consistency with the City of Bakersfield General Plan; and WHEREAS, on Wednesday, September 30, 1992, the Council of the City of Bakersfield, pursuant to the provisions of the "Public Streets, Highways and Service Easements Vacation Law," being Chapter 3 of Part 3 of Division 9 of the Streets and Highways Code of the State of California, passed and adopted its Resolution of Intention No. 1099 declaring its intention to order the vacation of the north/south alley connecting Bernard Street to Jefferson Street, between Alta Vista Drive and Inyo Street (Block 7 of Alta Vista Tract), in the City of Bakersfield, County of Kern, State of California; and WHEREAS, said Council did fix a time and place for hearing all persons interested in or objecting to said proposed vacation, which said hearing was held on WEDNESDAY, October 21, 1992, after notices were duly published and posted as required by law. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The above recitals are true and correct and are incorporated herein. 2. The north/south alley connecting Bernard Street to Jefferson Street, between Alta Vista Drive and Inyo Street (Block 7 of Alta Vista Tract); and, in the City of Bakersfield, County of Kern, State of California, more particularly described as all of the 25 foot wide alley in Block 7 of the ALTA VISTA TRACT as shown on map filed January 29, 1923 in Book 3 of maps, Page 71 in the office of the Kern County Recorder, is unnecessary for present or prospective street purposes and is hereby vacated, subject to the conditions enumerated herein. 3. A nonexclusive easement and right of Way shall be reserved for public utilities and municipal service facilities to lay, construct, operate, maintain, repair, reconstruct, change the size of or remove pipelines, conduits, cable, wires, poles or any other structures, fixtures or equipment, in, under, across, over and upon the entire above described alley area. 4. As a condition of completion of said vacation, petitioner shall provide for street improvements (curb, gutter and sidewalk) to be constructed to City standards along the northerly and southerly limits of the vacated area subject to Section 8324 of the Streets and Highways Code of the State of California. 5. The City Clerk shall certify the passage of this Resolution and when the City Clerk receives notice from the City Public Works Department that the street improvements referenced in paragraph 4 have been provided, the City Clerk shall cause a certified copy of this resolution , attested by the Clerk under the seal of the City, to be recorded in the Office of the County Recorder of the County of Kern, California. .........
