HomeMy WebLinkAboutRES NO 10-89RESOLUTION NO. 10-89 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD SETTING SALARIES AND RELATED BENEFITS FOR OFFICERS AND EMPLOYEES OF THE GENERAL SUPERVISORY, POLICE SUPERVISORY AND MANAGEMENT UNITS AND ADOPTING CITY SCHEDULE OF PAID HOLIDAYS FOR ALL CITY EMPLOYEES AND ALL BARGAINING UNITS. WHEREAS, the Charter of the City of Bakersfield, Section 12, authorizes the City Council to provide for salaries and related benefits for officers and employees of the City; and WHEREAS, the Council has determined what such salaries and related benefits should be for such officers and employees of the City to be in effect on the second day of January, 1989. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: SECTION 1. Term of Agreement The City and the Union agree that the term of this agree- ment shall commence on January 2, 1989 and expire at 12:00 mid- night on January 1, 1991 for the General and Supervisory and Management Units. The term for Police Supervisory shall be for one year, commencing January 2, 1989 and ending at 12:00 midnight on January 1, 1990. SECTION 3. Salary Schedule Commencing on the second day of January 1989, or as other- wise therein specified, the attached documents shall be the Salary Schedule for officers and employees in the General Supervisory Unit, Police Supervisory Unit, Management Unit and the City Manager and is hereby adopted and incorporated into this resolu- tion as though fully set forth herein, thereafter this resolution shall be published in printed form. Effective January 2, 1989, salary ranges shall be increased by four (4%) percent for all classifications (Schedule A). Effective January 1, 1990, salary ranges shall be increased by four (4%) percent for all classifications except Police Supervisory (Schedule B). In February of 1989, Personnel shall conduct a review of supervisory titles. SECTION 4. Car and Mileage Allowances A. Department heads, and the City Attorney, who are not furnished an official City car shall be reimbursed for automobile use at the rate of THREE HUNDRED TWENTY-FOUR DOLLARS ($324.00) per month. B. Those City officers not furnished an official City car who shall be reimbursed at the rate of FIFTY DOLLARS ($50.00) per month are the Planning Director, Assistant City Attorneys, Deputy City Attorneys, Assistant Public Works Manager, Assistant Auditorium Manager, Finance Director, Assistant Finance Director, Community Development Coordinator and Economic Development Director. Car allowances for mid-management will be examined for possible adjustment in the 1989-90 budget. C. Mileage allowances on the above where the car is in use on City business shall be allowed based upon factors of gasoline costs and maintenance costs; provided, however, that City officers named in subsection A. shall receive mileage allowances only for out-of-town travel on City business. D. The car allowance provided in subsection A. shall be annually determined based upon the factors of leasing costs, gaso- line costs and up-keep cost increases, if any, from year to year. SECTION 5. Medical and Dental Insurance The City and Union have agreed that all future meeting and conferring and decisions regarding the structure of - 2 - medical/dental insurance coverages shall take place through the Joint City/Employee Medical Insurance Committee. The Committee shall consist of representatives from each Unit and the City. There shall be a good faith effort to make all decisions by October 31 of each year. Discussions as to the City's contribution toward medical/dental insurance shall continue to be determined through the formal meet and confe~ process between the City and the individual Units. Effective January 1, 1989, the City shall provide bi- weekly contributions toward a medical, vision, and dental plan for all officers and employees of the City, subject to the following maximum City contributions: Employee Bi-Weekl~ City Maximum* Bi-Weekl~ Single coverage $ 2.31 $ 48.23 Two-party coverage 4.62 96.47 Family coverage 6.92 $146.82 * City will pay up to maximum amount depending upon plans chosen by employee. Retired Employees: Effective May 1, 1985, retired employees covered under the City's health plan shall receive City contributions based on the following formula: the City shall contribute two percent (2%) of the monthly premium for Health Net (under age 65 rate) times each year of service (to the nearest half year) for single-party coverage, and one and one-half percent (1-1/2%) of monthly premium for two-party coverage for Health Net (under age 65 rate) times each year of service (to the nearest half year) for retired employees with two-party and family coverage. Effective January 1, 1985, only employees retiring with a minimum of fifteen (15) years' accumulated service shall be eligible for participation in the Retiree Medical Insurance Program. Retired Safety_Employees: The fifteen (15) year minimum requirement for participation shall be waived for employees retiring and awarded a job-related disability. Employees retiring with job-related disability shall be credited with either eight (8) years of service or their actual accumulated service time, whichever is greater for the purpose of calculating the retiree medical allowance under the City's adopted formula. - 3 - Retired Non-S~ty Employees: Effective January 1, 1985, only employees retiring with a minimum of fifteen years' accumulated service shall be eligible for participation in the Retiree Medical Insurance Program. The fifteen year minimum shall be waived for employees retiring because of disability. Retiree Medical: Eligibility and contributions toward retiree medical insurance shall be as set forth in the Supplemental Memorandum of Understanding between the City and Blue and White Collar Units regarding health benefits dated November 23, 1988. Effective immediately, any employee eligible to receive retiree medical insurance coverage who is eligible for Medicare coverage, whether through the City of Bakersfield, other employers, spouse coverage, or for any other reason, shall be required to obtain and utilize such coverage as a condition for receiving coverage under the City's plan. SECTION 5. Life Insurance The City shall provide a basic term life insurance policy of $2,000 value for City Councilmembers and all employees included within this resolution. In addition, the City shall provide contributions toward a life insurance plan as follows: A. Management Unit - One hundred percent (100%) of the insurance premium for each officer and employee, such insurance coverage equal to their projected annual base salary to the nearest $500. B. Employees in the White Collar Unit Classified as Confidential before July 1, 1981 - Fifty percent (50%) of the life insurance premium for $10,000 life insurance per employee. C. General Employees, Supervisory Unit - One hundred percent (100%) of the life insurance premium for a policy equal to the employee's projected annual base salary to the nearest $500 of a minimum amount of $15,000. D. Police Unit - One Hundred Percent (100%) of the premium for each employee for a life insurance policy in the amount of $10,000. E. Police Supervisory Unit - One Hundred Percent (100%) of the insurance premium for each employee, such insurance cover- age equal to the employee's annual base salary to the nearest $500. - 4 - F. Ail of the provisions of Section 6 are subject to each officer's or employee's option to have insurance in the amounts they desire within the limitations herein set forth. SECTION 7. Deferred Income Ail probationary and permanent employees of the City shall be eligible to participate in the City's Deferred Income Plan. SECTION 8. Administrative Leave Officers and employees may be granted administrative leave under Section 2.84.620(d) of the Bakersfield Municipal Code and Section III - 1.3.3 of the Administrative Rules with the approval of the department head and the City Manager. SECTION 9. Uniform and Tool Allowance The City shall provide a uniform allowance as follows: A. Police Supervisory and Police Management, safety members - FIVE HUNDRED EIGHTY FIVE DOLLARS ($585.00) per year, payable in July. If such employee terminates before July 1st of the following fiscal year, said employee shall reimburse City on a pro rata basis. B. Motorcycle Officers, Supervisory - Additional TWENTY-FIVE DOLLARS ($25.00) per quarter. C. Miscellaneous Police Supervisory, nonsafety employees required to wear uniforms - TWO HUNDRED FIFTY DOLLARS ($250.00) per year, payable semi-annually. Temporary employees of the Police Department required to wear uniforms will be paid ONE HUNDRED FIFTY DOLLARS ($150.00) annually, payable semi- annually. If an employee terminates before conclusion of the period for which payment has been received, such employee shall reimburse City on a pro rata basis. D. Fire Management - FOUR HUNDRED DOLLARS ($400.00 per year; payments in 1989 and 1990 shall be made as follows: TWO HUNDRED DOLLARS ($200.00) payable on July 1, and an additional TWO HUNDRED DOLLARS ($200.00) payable on December 1. - 5 - E. General Supervisory employees required to wear uniforms will be furnished uniforms at no cost to the employee. F. General Supervisory employees who are required to provide a full complement of hand tools shall be reimbursed for replacement of such tools up to THREE HUNDRED DOLLARS ($300.00) annually. SECTION 10. Accumulated Sick Leave Payment of accumulated sick leave in event of death or resignation of a member of the Management Unit, General Employees Supervisory Unit and Police Supervisory Unit shall be as follows: A. One-half of the unused sick leave shall be paid to the member's beneficiary or estate in the event of such member's death prior to his separation from City employment after ten (10) years' service. B. One-half of the unused sick leave shall be paid to such member whose employment is terminated for any reason, other than discharge, after ten (10) years' service. SECTION 11. Designated Holidays - General~ Police and Fire Su~ervisor_~ Units and Management Unit A. Ail eligible employees in the General Employees Supervisory, Police Supervisory, Fire Supervisory and Management Units not working on a shift basis shall observe the following eight-hour holidays with pay for calendar years 1989 and 1990 as follows: -1989- February 13 February 20 Lincoln's Birthday Washington's Birthday May 29 Memorial Day July 1 Three (3) Floating Holidays Credited* July 4 Independence Day - 6 - September 4 November 23 November 24 December 25 January 1, 1990 Labor Day Thanksgiving Day Day After Thanksgiving Christmas Day New Year's Day February 12 February 19 May 28 July 1 July 4 September 3 November 22 November 23 December 24 December 25 December 31 January 1, 1991 -1990- Lincoln's Birthday Washington's Birthday Memorial Day One (1) Floating Holiday Credited* Independence Day Labor Day Thanksgiving Day Day After Thanksgiving Christmas Eve Day Christmas Day New Year's Eve Day New Year's Day * Note: Trading Veterans Day (Saturday in 1989 and Sunday in 1990) for an additional floating holiday. Floating holidays shall be available for use by employees during the full fiscal year. In 1990, Christmas and New Years fall on Tuesday. Two floating holidays traded (leaving one) for the full day before Christmas and New Years, resulting in two four-day weekends. The floating holidays referred to above shall be selected by an eligible employee who is in the employ of the City as of July 1, provided such selections shall be consistent with the efficient operation of the affected department and the activities and convenience of the City and shall first have the approval of the department head. - 7 B. Eligibility. Ail probationary and permanent employees in the Blue Collar, White Collar, General Employees Supervisory, and Management Units, Fire Department employees not working a 24-hour shift and Police Department employees not working on a shift basis, shall be eligible to observe holidays in the manner herein provided. C. Holiday Work. When such employee is required to work on a holiday, the eligible employee shall be credited for the holiday once at the straight time rate and shall be credited once again for the actual time worked as overtime at the employee's applicable overtime rate. General Supervisory Unit employees working on a holiday designated in subsection A. shall be credited for overtime at time and one-half. D. Holidays on Day Off. When a holiday falls on an employee's scheduled day off, the eligible employee shall be credited for the holiday as overtime at the straight time rate. E. Designated ~91i~ays and Manner of Payment for Holiday Work on Shift Basis Police Sup__e~visory and Management. All eligible employees in the Police Supervisory and Management Unit working on a shift basis, except those employees who are absent without pay one-half day or more immediately before and/or after a designated holiday, shall be paid at the rate of one and one-half (1-1/2) times their regular hourly rate of pay for the holidays listed in subsection A. except that in lieu of a floating holiday and one-half days on Christmas Eve and New Year's Eve they will be credited for Columbus Day and Easter Sunday. One payment for all such designated holidays shall be made on or before June 17. All other eligible Police Supervisory and Police Management employees who do not work a shift basis shall observe holidays in accordance with Subsection A of this Section. F. Holidays at Termination - Police. An employee leaving permanent City service shall be allowed regular compen- sation for holidays worked up to the effective date of termination. G. Holidays - Fire Department Employees Assigned to 24-Hour Duty Shifts. Fire Management Employees assigned on a ~4-hour duty shift basis shall accrue holiday pay at the rate of five and one-half (5-1/2) shifts per year to be paid on a pro rata basis as follows: one-half (1/2) on December 1, and one-half (1/2) on June 30. H. Special Holidays. Occasional special holidays declared by the President or Governor and approved by the City Manager in commemoration or memoriam of an extraordinary - 8 - occurrence shall be observed by the reduction of the operation of all departments as much as practicable. All eligible employees who are required to work on such a holiday shall be compensated at their regular hourly rate of pay for those special holidays worked, and in addition be credited with compensatory time on a straight hour-for-hour basis for the special holiday hours worked, to be taken off on another day as determined by the department head. Compensatory time for Fire Department safety employees working a 24-hour duty shift on such a holiday shall be one-half of a shift (12 hours). SECTION 12. P.E.R.S. Contribution In addition to amounts presently paid by City, the City shall pay the following contribution to P.E.R.S. (Public Employees Retirement System) normally paid by the employee: A. Seven percent (7%) for General Supervisory Units who were in the employment of the City on July 1, 1983. Those employed after July 1, 1983, shall not be eligible to the seven percent (7%) City contribution to P.E.R.S. until the completion of six years of continuous employment with the City. B. Police Supervisory and Police Management - nine percent (9%) - Except those employees hired on or after July 1, 1983, the City shall pay for four percent (4%) of the employee P.E.R.S. contribution commencing January 7, 1985, until the seventh uninterrupted year of service, at which time the City contribution shall increase to nine percent (9%). C. Fire Management nine percent (9%) Except those employees hired on or after July 1, 1983, the City shall pay two percent (2%) of the employee P.E.R.S. contribution commencing January 7, 1985, until the seventh uninterrupted year of service, at which time the City contribution shall increase to nine percent (9%). D. Management Unit, except police and fire management (safety) - seven percent (7%). follows: The City shall SECTION 13. ~ongevity Pay compensate employees for longevity as - 9 - A. Police Supervisory Unit - After four (4) years of continuous service as a sergeant, police supervisory employees shall receive longevity pay in an amount equal to three percent (3%) of the employee's base salary; after eight (8) years, six percent (6%) and after twelve (12) years of service as a sergeant, nine percent (9%). Effective January 1, 1985, employees receiving longevity pay shall have that pay converted to a flat dollar amount. Those employees shall continue to receive the dollar amount received as of January 1, 1985, for as long as they would have retained eligibility for longevity pay under the existing longevity pay rules. For all other employees, the longevity pay program is eliminated effective January 1, 1985. B. General Employees Supervisory Unit - Effective the first full pay period in April 1984, the City will institute a Longevity Pay Program for unit members as follows (the amounts are not cumulative): 10 or more uninterrupted years of City employment - two percent (2%) of base pay. 15 or more uninterrupted years of City employment - four percent (4%) of base pay. 20 or more uninterrupted years of City employment - six percent (6%) of base pay. Employees hired after January 1, 1985, shall be not be eligible for longevity pay. SECTION 14. Incentive Pay Effective the first pay period after April 24, 1985, the City shall pay police supervisory employees an additional two and one-half percent (2-1/2%) of their salary as incentive pay in lieu of the two and one-half percent (2-1/2%) currently paid for supervisory certificate. This incentive pay and the super- visory certificate pay will be discontinued for all employees entering the Supervisory Unit after December 27, 1985. City shall contribute an additional five percent (5%) of employee's base salary to all police management and police supervisory employees possessing either an intermediate or advanced certificate, or both, issued by the Police Officers Standards and Training Commission (P.O.S.T.). - 10 - City shall contribute an additional five percent (5%) of employee's base salary to fire management personnel holding an Associate in Arts Degree which fulfills all requirements of a Fire Science Certificate and five (5) years' employment with the Bakersfield Fire Department, or two and one-half percent (2-1/2%) of employee's base salary for those safety personnel in the Bakersfield Fire Department who have obtained a Fire Science Certificate requiring thirty (30) units and eight (8) years' employment of Fire Management Certificate requiring twenty-one (21) units and eight (8) years' employment with the department. SECTION 15. Shift Differential (A) General Supervisory Unit employees shall receive a shift differential of $.55 per hour which will be paid when the majority of their shift falls between the hours of 3 P.M. and 12 Midnight. Effective January 1, 1990, the differential shall be increased to $.65 per hour. (B) General Supervisory Unit employees shall receive a shift differential of $.75 per hour which will be paid when the majority of their shift falls between 12 Midnight and 7 A.M. Effective January 1, 1990, the differential shall be increased to $.85 per hour. SECTION 16. Stand-By Pay Police Supervisory Unit employees who are directed to remain on ready stand-by during off-duty hours shall be compen- sated at the rate of TWENTY FIVE DOLLARS ($25.00) per eight-hour shift of such ready stand-by service. Such employees actually called back to work during stand-by assignment shall be paid for both the ready stand-by rate and the hourly rate for one and one- half times the hours worked, computed to the nearest one-tenth of an hour (six minutes). All ready stand-by assignments must be authorized by the department head. SECTION 17. Contract Services Attorneys who provide contract services to other cities, outside of the normal working hours, shall be compensated at the rate of fifty percent (50%) of the hourly rate paid to the City by the contract city. Contract services to other cities to con- clude February 28, 1989. - 11 - SECTION 18. Residency Requirement General Supervisory Unit employees living within 45 minutes normal driving time from City Hall shall be deemed as satisfying residency requirements. No such employee living out- side the City limits or more than 14 miles from City Hall shall be assigned a City vehicle to take to and from the employee's residence. SECTION 19. Physical Assessment Program At least once during the term of Agreement, the City will offer the Police Supervisory unit employees the opportunity to receive a comprehensive physical assessment and follow-up counseling session. The assessment will measure: Cardiovascular fitness Blood pressure Blood composition (cholesterol, Body composition Muscular endurance Flexibility etc.) When indicated by initial results, follow-up testing will be performed. Results of the assessment will be confiden- tial and for the individual employee's use only. The City will receive composite data to be used in evaluating the need for training seminars, etc. The program will be provided on work time and will be voluntary. SECTION 20. Jury Duty The City shall amend its Administrative Policy and Procedure regarding jury duty to provide for paid leave when an employee is subpoenaed to appear as a witness in court in Kern County on matters of civic concern.
