HomeMy WebLinkAboutRES NO 7-00RESOLUTION._ ,~'" 0 0 RESOLUTION FINDING REDEVELOPMENT ASSISTANCE NECESSARY TO CARRY OUT PURPOSES OF THE REDEVELOPMENT PLAN WHEREAS, the City of Bakersfield and the Bakersfield Redevelopment Agency (RDA) desire to effectuate the purposes of the redevelopment plan within the Downtown Bakersfield Redevelopment Project Area ("Project Area"); and WHEREAS, a developer desires to construct a 68,300 square foot building and parking facilities at 2000 K Street, in the City of Bakersfield ("the Project"); and WHEREAS, under California Health and Safety Code Section 33421, as enacted by the State of California, a redevelopment agency may provide for the installation and construction of off-site improvements necessary for carrying out the redevelopment plan in a redevelopment project area; and WHEREAS, the Project will be located in the Project Area; and WHEREAS, under California Health and Safety Code Section 33421.1, as enacted by the State of California, the redevelopment agency may not use its authority to assist in off-site improvements without the consent of the legislative body; and WHEREAS, the RDA desires to assist the developer by reimbursing to it the costs of installing off-site improvements which will keep the Project in conformity with the Chester Avenue Streetscape; and WHEREAS, such off-site improvements will create an attractive streetscape environment which significantly improves pedestrian activity, character, and image within the Project Area; and WHEREAS, such reimbursements shall be paid to developer from the tax increment which is generated by the Project; and WHEREAS, developing the Project in the Project Area will cost the developer more than if the Project were located outside of the Project Area; and WHEREAS, without the RDA's assistance in the off-site improvements, the developer will not be able to construct the Project in the Project Area. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield that, based on the findings of this Council, it is found and determined that: Page 1 of 2 1. The above-recitals are true and correct. 2. The RDA's assistance in the reimbursement of off-site streetscape improvements is necessary to effectuate the purposes of the Amended Downtown Bakersfield Redevelopment Plan.
