HomeMy WebLinkAboutRES NO 126-92RESOLUTION NO. 126-92 RESOLUTION AMENDING THE OFFICIAL LIST OF DESIGNATED SPEED ZONES, PURSUANT TO SECTIONS 22357 AND 22358 OF THE CALIFORNIA VEHICLE CODE. WHEREAS, the Council of the City of Bakersfield, pursuant to Sections 22357 and 22358 of the California Vehicle Code, desires to enact prima facie speed limits on portions of roadways within the City of Bakersfield; and WHEREAS, said prima facie speed limits are being established for streets in the City of Bakersfield, after traffic engineering surveys were conducted; and NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: Under provision of Sections 22357 and 22358 of the California Vehicle Code, the prima facie speed limits for the following streets, or portions thereof, are hereby determined and declared to be as shown below, and shall be included in the official City "List of Speed Zones": 1. North Laurelglen Boulevard, from Wilford Court to Gosford Road, to be forty (40) miles per hour. South Laurelglen Boulevard, from Gosford Road to Wilford Court, to be forty (40) miles per hour. Panama Lane, from Stine Road to South "H" Street, to be fifty (50) miles per hour. .......... o0o .......... MEDDERS MAYOR of the City of Bakersfield APPROVED as to form: ~-~ITY ATTORNEY o~-f~the City of Bakersfield - 2 - ESTABLISHING SPEED LIMITS ON CITY STREETS In an effort to provide for the safe and efficient movement of traffic, speed limits have been established throughout the City. These speed limits were first established in 1980 and have either been revised as traffic patterns have changed or expanded as the City has continued to grow. The California Vehicle Code (C.V.C.) gives us the criteria by which we can establish speed limits. Certain speed limits are defined in the C.V.C. based on the condition or type of roadway. These speed limits are as follows: 15 m.p.h. 1. Over certain railroad crossings. 2. Through a "blind" intersection. On an alley. 25 m.p.h. 1. In a "Residence" district 2. In a "Business" district. In a school zone. 55 m.p.h. Maximum speed limit within the State of California. The C.V.C. allows us to increase the 25 m.p.h. limit or decrease the 55 m.p.h. limit if that change is justified by an "Engineering and Traffic Survey". The "Engineering and Traffic Survey" for a given roadway section consists of performing a spot speed survey, reviewing accident history associated with excessive speed and reviewing conditions which are not apparent to the driver. This survey is then used to establish and justify a speed limit. If a posted speed limit is not justified by an "Engineering and Traffic Survey", the speed limit may be deemed unenforceable by the courts. The "Engineering and Traffic Survey" must be renewed every five (S) years to show the posted speed limit is still justified. ff the "Engineering and Traffic Survey" has expired, the speed limit is deemed a "speed trap" and is therefore unenforceable. Pursuant to the requirements of the C.V.C., the Traffic Division recommends changes to existing speed limits on the following street segments: Speed Existing Propoeed Zone Speed Speed Council Wards #4 and #6 North Laurslgien Boulevard, from W'dford Court to Cosford Road 4~ m.p.h. 40 m.p.h.
