RESOLUTION CALLING THE SPECIAL MUNICIPAL
ELECTION FOR AMENDMENT TO THE CITY CHARTER AND
REQUESTING THE BOARD OF SUPERVISORS OF THE
COUNTY OF KERN TO ORDER CONSOLIDATION OF SAID
ELECTION WITH THE STATE OF CALIFORNIA GENERAL
ELECTION TO BE HELD TUESDAY, NOVEMBER 3, 1992.
W~EREAS, the State of California Special Municipal Election
will be held on November 3, 1992; and
W~EREAS, the Council proposes to submit an amendment to the
City Charter in the manner set forth in Chapter 3, Division 2, of
Title 4 (commencing with section 34450 of the Government Code of
the State of California), at a Special Municipal Election; and
W~EREAS, Section 23302 of the Elections code of the State of
California provides that whenever an election called by a City for
the submission of any proposition or office to be filled is to be
consolidated with a statewide election, and such proposition or
office to be filled is to appear upon the same ballot as that
provided for such statewide election, the City shall at least 88
days prior to the date of the election, file with the Board of
Supervisors, and a copy with the County Clerk, a resolution
requesting such consolidation and setting forth the exact form of
any proposition or office to be voted upon at such election, as the
same are to appear on the ballot; and
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield as follows:
1. That the Special Municipal Election is hereby called to be
held in the City of Bakersfield on Tuesday, the 3rd day of
November, 1992, for submitting to the electors, the Charter
Amendment as follows:

Shall Section 67 of the Bakersfield City
Charter be amended to change the years of the
General Municipal Election from odd to even-
numbered years for election of members of the
Council?

2. That the Board of Supervisors of the County of Kern
is hereby requested to make an order, pursuant to Sections 23302 et
seq. of the Elections Code of the State of California,
consolidating the Special Municipal Election for the purpose of
submitting to the qualified electors an Amendment to the Charter of
the City of Bakersfield and the State of California General
Election.
3. That the polls will be open for the purpose of
holding said elections on said November 3, 1992, between the hours
of 7:00 A.M. and 8:00 P.M.
4. That said Board is further requested to provide that
within the City of Bakersfield, the election precincts, polling
places and voting booths shall, in every case, be the same and
there shall be only one set of election officers in each of the
precincts established in the city for consolidated City elections
and the General Election and that the exact form of the measures to
be voted upon, and the office to be filled shall be as set forth in
each ballot to be used at said elections within the City of
Bakersfield.
5. That said Board of Supervisors of Kern County is
further requested the measure to be printed upon each of the
ballots to be used in the City of Bakersfield at said Special
Municipal Election for a charter amendment consolidated as
requested, within the City, including absent voter ballots. Said
Board is further requested to cause to be set forth the measure on
all sample ballots relating to both City elections called and
consolidated, and to mail to the qualified electors within the City
said sample ballots and voter's pamphlets and arguments, if any,
relating to said elections, all in the time and in the form
required by law, and to provide absent voter ballots for said
consolidated elections for use by electors of the City of
Bakersfield who may be entitled thereto in the manner provided by
law.
6. That the Board of Supervisors of the County of Kern
is hereby authorized to canvass, or cause to be canvassed, the
returns of said Special Municipal Election for Charter Amendment,
and are requested to provide a "Statement of Election Results" to
the City Clerk.
7. That the City Clerk is hereby directed to transmit
and file certified copies of this resolution with the Board of
Supervisors of Kern County and the County Clerk of Kern County, as
required by Section 23302 of the Elections Code of the State of
California.
