A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD ADOPTING THE CONGESTION MANAGEMENT
PROGRAM LAND USE ANALYSIS PROGRAM.
WHEREAS, Government Code Sections 65088 and 65089 require
every county that includes an urbanized area to designate a
Congestion Management Agency; and
WHEREAS, the Kern Council of Governments (Kern COG) has
been designated the Congestion Management Agency for Kern County;
and
WHEREAS, the Congestion Management Agency is required to
annually develop and adopt a Congestion Management Program; and
WHEREAS, the Congestion Management Program has been
developed in consultation with, and with cooperation of, the
transportation planning agency, regional transportation providers,
local governments, the California State Department of
Transportation, and the Air Pollution Control District; and
WHEREAS, the Congestion Management Program has been
approved by all Kern County cities and the County of Kern; and
WHEREAS, the Kern Council of Governments has adopted the
Congestion Management Program; and
WHEREAS, California Government Code Section 65089.3
requires the Congestion Management Agency to monitor the
implementation of the Congestion Management Program, including the
adoption and implementation of a program to analyze the impacts of
land use decisions on the Congestion Management Program network;
and
WHEREAS, Chapter 5 of the Congestion Management Program
defines the land use analysis program to be adopted and implemented
by each city and county and requires local jurisdictions to submit
copies of all approved general plan amendments to the Congestion
Management Agency (Kern COG); and
WHEREAS, the City of Bakersfield must adopt and implement
the program defined in Chapter 5 of the Congestion Management
Program in order to conform to the Congestion Management Program.

NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Bakersfield as follows:
1. The above recitals are true and correct and are
incorporated herein by reference.
The Council of the City of Bakersfield does hereby
adopt the program to analyze the impacts of land
use decisions as defined by Chapter 5 of the Kern
County Congestion Management Program.
