RESOLUTION ADOPTING NEGATIVE DECLARATION
FOR THE ROSEDALE INTERCHANGE
RECONSTRUCTION.
WHEREAS, Caltrans as lead agency, adopted the Negative Declaration
(SCH #87010503) for the reconstruction of the Rosedale Interchange (Highways 58, 99
and 178) in 1987; and
WHEREAS, the adoption of the Negative Declaration by Caltrans (Lead
Agency) was in accordance with CEQA regulations; and
WHEREAS, the project description for said project included evaluation of
landscaping, including tree, shrub and groundcover; and
WHEREAS, only revegetation of interchange slopes for erosion control was
adopted as a mitigation measure; and
WHEREAS, the City of Bakersfield desires to pursue alternative funding
sources for the installation of enhanced landscaping beyond what is required by the
existing mitigation measure; and
WHEREAS, the City of Bakersfield's landscaping plans would have no
further impact than considered under the Negative Declaration adopted by the Lead
Agency; and
WHEREAS, as it is necessary to have completed an environmental
document in order to compete for grant monies provided for landscaping projects in
public right-of-way; and
WHEREAS, CEQA Section 15231 permits the Negative Declaration
adopted by a Lead Agency to be conclusively presumed to comply with CEQA for
purposes of use by responsible agencies which were consulted pursuant to CEQA
Section 15072 or 15082; and
WHEREAS, the City of Bakersfield was determined to be a responsible
agency and consulted pursuant to CEQA Section 15072; and
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of Bakersfield:
1. All of the foregoing recitals are hereby found to be true and
correct.
The Negative Declaration is hereby approved and adopted.
