Resolution No. 63-92
A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AUTHORIZING THE PUBLIC WORKS
DIRECTOR OR HIS DESIGNEE TO ACCEPT CERTAIN
DEEDS OR GRANTS CONVEYING AN INTEREST IN OR
EASEMENT UPON REAL PROPERTY FOR PUBLIC
PURPOSES.
WHEREAS, California Government Code Section 27281 provides
that deeds or grants conveying any interest in or easement upon
real property to a governmental agency for public purposes shall
not be accepted for recordation without the consent of the
governmental agency; and
WHEREAS, California Government Code Section 27281 further
provides that a governmental agency may, by general resolution,
authorize one or more officers or agents to accept and consent to
such deeds or grants; and
WHEREAS, Section 12 of the Charter of the City of
Bakersfield provides that the City may exercise any rights,
powers, and privileges granted by the general laws of the State;
and
WHEREAS, the administrative efficiency of City government
will be enhanced by allowing the Public Works Director or his
designee to accept certain grants or deeds without requiring
action by the City Council.
NOW, THEREFORE, BE IT RESOL¥~u by the Council of the City of
Bakersfield as follows:
1. All of the foregoing recitals are found to be true and
correct.
2. The Public Works Director of the City of Bakersfield,
or his designee, is hereby authorized to accept for recordation,
in accordance with the requirements of California Government Code
Section 27281, deeds or grants conveying a fee simple interest
subject to a reverter in or easement upon real property to the
City of Bakersfield for public purposes.
3. The City Clerk shall certify to the passage of this
Resolution and shall cause a certified copy hereof, attested by
the Clerk under the seal of the City, to be recorded in the
Office of the County Kecorde~ of the County of Kern, California.
