A RESOLUTION APPROVING THE DESIGNATION OF THE
KERN COUNTY ENVIRONMENTAL HEALTH SERVICES
DEPARTMENT AS THE LOCAL ENFORCEMENT AGENCY FOR
SOLID WASTE MANAGEMENT PEP/~ITTING, INSPECTION
AND ENFORCEMENT.
WHEREAS, the California Integrated Waste Management Act
of 1989 (Stats. 1989, Ch. 1095) permits the designation of a local
enforcement agency for purposes of enforcing the applicable
standards of Chapter 1, Part 4, of Division 30 of the Public
Resources Code (commencing at Section 43000) and the regulations
adopted thereunder pertaining to solid waste handling and disposal
for the protection of air, water and land from pollution and
nuisance, and for the protection of the public health and
consistent with the provisions of Public Resources Code Section
43209; and
WHEREAS, pursuant to the provisions of Public Resources
Code Section 43202(a), the Board of Supervisors of the County may
designate the local enforcement agency, subject to the approval by
a majority of the cities within the County which contain a majority
of the population of the incorporated areas of the County; and
WHEREAS, the Kern County Environmental Health Services
Department is the currently designated local enforcement agency and
has the requisite technical expertise, adequacy of staff resources,
adequacy of budget resources, and training in order to carry out
the function of the local enforcement agency; and
WHEREAS, no currently designated enforcement ~gency may,
after August 1, 1992, exercise the powers of an enforcement agency
unless it has been certified by the California Integrated Waste
Management Board pursuant to the applicable provisions of the
California Integrated Waste Management Act of 1989; and
WHEREAS, it is in the best interests of the County and
the incorporated cities within the County to maintain the
designation of the Kern County Environmental Services Department
as the local enforcement agency in order to promote continuity in
the enforcement of the standards for solid waste handling within
the County and to ensure that the enforcement and inspection be
maintained as the local level.
NOW, THEREFORE, BE IT H~J~RYRESOLVEDby the City Council
of the City of Bakersfield, as follows:
1. This Council does hereby approve the designation of
the Kern County Environmental Health Services Department as the
local enforcement agency pursuant to the provisions of the
California Integrated Waste Management Act of 1989.

2. The City Clerk shall cause a copy of this Resolution
to be sent to the Kern County Board of Supervisors and the Kern
County Environmental Health Services Department.
