RESOLUTION APPROVING AMENDMENTS TO
THE KERN COUNTYWIDE SITING ELEMENT
WHEREAS, the Kern County Waste Management Department intends to make
minor amendments to the text of the Countywide Siting Element to reflect current permit
information; and
WHEREAS, the applicant, Kern County Waste Management Department, intends
to expand the disposal area of the Bakersfield Metropolitan (Bena) Class 3 Sanitary Landfill
into a new cell within the facility boundary; and
WHEREAS, the Kern Countywide Siting Element needs to be amended to reflect
the expansion of this facility; and
WHEREAS, the Kern County Waste Management Department has prepared a
report recommending that the expansion of the Bakersfield Metropolitan (Bena) Class 3
Sanitary Landfill is in conformance with the Kern Countywide Siting Element and a second
report recommending that these minor revisions to the text of the Countywide Siting
Element are in conformance with the Kern Countywide Siting Element; and
WHEREAS, the Kern County Waste Management Department has prepared a
Supplemental Environmental Impact Report (SEIR) and the Kern County Board of
Supervisors has certified this SEIR; and
WHEREAS, the City Clerk for the City of Bakersfield has caused notice to be duly
given of a public hearing on these matters in accordance with the law, as evidenced by the
affidavit of publication and the affldavi[ of mailing on file with the City Clerk; and
WHEREAS, all persons desiring to be heard in these matters have been duly heard,
and the City Council having considered the testimony presented during said public hearing,
all documents presented during said public hearing and the report and recommendations
of the Kern County Waste Management Department having also been considered.
NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Bakersfield
as follows:
1. The above recitals are true and correct and incorporated herein by reference.
2. The City Council has no objections to the proposed amendments to the Kern
Countywide Siting Element concerning the aforesaid applications.
