RESOLUTION AGREEING TO ACCEPT TITLE FROM THE
STATE FOR PARCELS OF RIGHT-OF-WAY ON PIERCE
ROAD, NORTH OF STATE ROUTE 178 AND AGREEING TO
ASSUME MAINTENANCE AND CONTROL UPON STATE
RELINQUISHMENT.
WHEREAS, the State of California is the owner of four (4)
parcels of State highway right-of-way on Pierce Road, north of
State Route 06-KER-178, as said parcels are shown, outlined in red,
on the map entitled EXHIBIT "A" attached hereto and made a part
hereof; and
WHEREAS, State has acquired additional right-of-way along
Pierce Road in connection with State's improvements on 06-KER-99
and has improved segments of Pierce Road as part of the freeway
improvements; and
WHEREAS, State desires to limit ownership of local street
right-of-way along Pierce Road; and
WHEREAS, said parcels properly belong under the
jurisdiction of the City of Bakersfield.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of
the City of Bakersfield, as follows:
a. That the City of Bakersfield agrees to accept title
to said highway right-of-way and assumes control and maintenance of
said highway right-of-way upon relinquishment by the State of
California.
b. That the City of Bakersfield does hereby waive the
90 days' notice requirement of the intention of the California
Highway Commission to relinquish such State highway right-of-way as
provided in Section 73 of the Streets and Highways Code of the
State of California.
c. That the City Clerk is directed to forward two
certified copies of this resolution to
