A RESOLUTION APPROVING THE FILING OF AN
APPLICATION FOR EMERGENCY FUNDS FROM THE
NATURAL DISASTER ASSISTANCE ACT FOR THE
REMOVAL AND REPLACEMENT OF FREEZE-DAMAGED
TREES AND IRRIGATION BACK-FLOW DEVICES.
WHEREAS, the Office of Emergency Services, State of
California has been delegated the responsibility for the
administration of the Natural Disaster Assistance Act within the
state, setting up necessary procedures governing application by
local agencies under the program; and
WHEREAS, said procedures established by the Office of
Emergency Services, State of California, require the applicant to
certify by resolution the approval of application before submission
of said application to the state; and
WHEREAS, said application
applicant must comply with; and
contains assurances the
WHEREAS, the applicant will enter into an agreement
concerning emergency funds for natural disaster assistance with
Office of Emergency Services, State of California.
NOW, THEREFORE, BE IT HEaRty RESOLVED by the Council of
the City of Bakersfield as follows:
1. The City of Bakersfield shall file an application for
emergency funds under the Natural Disaster Assistance Act for the
removal and replacement of freeze-damaged trees and irrigation
back-flow devices; and
2. The City Manager is appointed as agent of the City
to conduct all negotiations, execute and submit all documents
including, but not limited to applications, agreements, amendments
and payment requests, which may be necessary for disaster
assistance funds; and
3. The City understands the assurances and certification
in the application form; and
4. The City Attorney is hereby appointed as legal
counsel of the City for purposes hereof.
