A RESOLUTION OREERING ~ SL%9~ARY VACATION OF 11.25 FEET
ON THE EAST SIEE OF JEW~,-A~£ AVENUE BETWEEN 36TH STREET AND
38TH STREET IN THE CITY OF BAKERSFIELD
W~IEREAS, Chapter 4 of Part 3 of Division 9 of the Streets and Highways
Code authorizes the City Council to su~narily vacate rights-of-way; and
%'HE BAKERSFIELD CITY SCHOOL DISTRICT petitioned the Council to vacate
the excess street right of way on the east side of Jewett Avenue between 36th
Street and 38th Street, described in full in Exhibit "A" attached hereto and in-
corporated as though fully set forth herein; and
WHEREAS, the subject street right-of-way is eligible for summary vaca-
tion on the basis that the street right-of-way is excess right-of-way no longer
needed for public street purposes; and
~IEREAS, the street right-of-way is unnecessary for present or prospective
public street purposes; and
WHEREAS, the Planning C~,k'0ission, at its meeting of October 17, 1991,
comsidered and found that the proposed vacation is consistent with the General
Plan of the City of Bakersfield.
NOW, THEREFORE, BE IT RESOLVEDby the Council of the City of Bakersfield
as follows:
1. All the foregoing recitals are found to be true and ~orrect. ~-
2. The proposed vacation is consistent with the General Plan of the
City of Bakersfield.
3. In accordance with Section 8334 of the California Streets & Highways
Code, the unused 11.25 feet of right-of-way on the East side of Jewett Avenue
between 36th Street and 38th Street, described in Exhibit "A" attached hereto and
incorporated as though fully set forth herein, is excess right-of-way no longer
needed for public street purposes.
4. The action herein taken is exempt fr~n the requirements of the
California Enviror~ntal Quality Act because there is no possibility that the
action may have a significant effect on the enviromment.
5. Pursuant to Chapter 4 of Part 3 of Division 9 of the Streets and
Highways Code, the above-described right-of-way is hereby vacated and shall no
longer constitute a public street.
6. The City Clerk shall certify to the passage of this Resolution and
shall cause a certified copy hereof, attested by the Clerk under the seal of the
City, to be recorded in the Office of the County Recorder of the County of Kern,
Califomia.

The East 11.25 feet of Jewett Avenue bounded on the North by the South line of
38th Street and bounded on the South by the North line of 36th Street as said
streets are shown on "Map of the City of Bakersfield, Kern County, California"
filed November 25, 1898 in the Office of the Kern County P~corder.
RESERVING THEREFRC~4 a nonexclusive easement and right of way for public
utilities, to lay, construct, operate, maintain, repair, reconstruct, change
the size df or remove pipelines, conduits, cable wires, poles or any other
structures, fixtures or equitx~ent, in, under, across, over and u~)n the
