A RESOLUTION OF APPLICATION PROPOSING
PROCEEDINGS FOR ANNEXATION OF TERRITORY TO
THE CITY OF BAKERSFIELD IDENTIFIED AS
ANNEXATION NO. 363, COLUMBUS NO. 1 ANNEXATION
(WARO 2).
WHEREAS, the Planning Commission of the City of Bakersfield, in
accordance with the provisions of Section 65353 of the Government Code, held a public
hearing on THURSDAY, AUGUST 15, 1991 AND SEPTEMBER $, 1991, on the
proposed annexation of certain properties to the City of Bakersfield known as
COLUMBUS NO. 1 ANNEXATION, notice of the time and place of hearing having been
given at least ten (10) calendar days before said hearing by publication in the Bakersfield
Californian, a local newspaper of general circulation; and
WHEREAS, by Resolution No. 68-91 on September 5, 1991, the Planning
Commission recommended approval of the annexation by this Council and this Council
has fully considered the findings made by the Planning Commission as set forth in that
Resolution; and
WHEREAS, the City of Bakersfield desires to propose a change of
organization, to wit, the annexation to the City of Bakersfield of the hereinafter-
described territop/, pursuant to Section $6800 of the Government Code of the State of
California.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield that it hereby finds and determines as follows:
1. That the City of Bakersfield hereby proposes the annexation to the City
of Bakersfield of the territory described in Exhibit "A" and shown on map marked
Exhibit "B", attached hereto and made a part of this resolution as though fully set forth
herein.
2. That a plan for providing services within the affected territory of the
proposed annexation, in accordance with the provisions of Section 56653 of the
Government Code, is marked as Exhibit "C", attached hereto and made a part hereof as
though fully set forth herein.

3. That this proposal for change of organization, to wit, annexation, is
made pursuant to the Cortese-Knox Local Government Reorganization Act of 1985, and
it is requested that proceedings be authorized for annexation in accordance therewith.
4. That the reasons for the proposed change of organization are that the
owners and residents of the affected territoW desire to receive municipal services from
the City of Bakersfield, and the City desires to receive tax revenues for benefits given
and to be given to the territory proposed to be annexed.
5. That for this proposed annexation and the zoning upon annexation,
therefore, Ordinance No. 3409, which was adopted November 6, 1991, an Initial Study
was conducted and it was determined that the proposed project would not have a
significant effect on the environment. A Negative Declaration was prepared and posted
on July 25, 1991.
6. That the laws and regulations relating to the preparation and adoption
of Negative Declarations as set forth in the California Environmental Quality Act and
City of Bakersfield Resolution No. 107-86 have been duly followed and the Negative
Declaration for this proposed annexation is hereby approved and adopted.
7. That the territory proposed for annexation as described herein has been
determined to be inhabited pursuant to the Cortese-Knox Local Government
Reorganization Act of 1985, Section 56046 of the Government Code.
8. That the names of the officers of the City of Bakersfield who are to be
furnished with copies of the Executive Officer's Report and who are to be given mailed
Notice of Hearing, if any, are:

A parcel of land being portions of the East half of Section 20 and the %~st half
of Section 21, Township 29 South, Range 28 East, M.D. M., Kern County, California,
more particularly described as follows:
Beginning at the point of intersection of the West boundary line of Tract No. 1088
and the South Right of Way line of Columbus Avenue as shown on map recorded in Book
4 of maps, Page 140 in the Office of the Kern County Recorder, said point being
on the existing corporate boundary of the City of Bakersfield;

through the City Police DeparL~ent located at the s/w corner of Truxtun
Avenue and Eye Street about 3 miles southwest of the annexation.
Fire-City Fire Station No. 4 located at the Southwest corner of Bernard
Street and Sacramento Street is less than ]/4 mile from the area.

Streets-The City Corporation Yard on Truxtun Avenue west of Freeway 99
will provide necessary facilities, personnel and services to
accommodate Public %{orks Department efforts. Maintenance
personnel will be dispatched from the Corporation Yard on a
regular basis for preventative maintenance and "As Needed" repair
including street construction and maintenance, sweeping of street~
and street light maintenance.
Sewer-The area is now served by the County Panorama-Mt. Vernon Sanitation
District and the area will remain under the jurisdiction of the sanitatior
district until further determination is made.
Water-The territory is now served by and will continue to be served by
California Water Service Company.
Other-(Refuse)-When annexed service will be provided by the City by
contract with a franchise collector or by City forces.
There will be no reduction in the range or
capacity of the City to provide the necessary
Public Works Services to this area. Service
will be on a regular basis "As Needed".

III.
What effects, if any, would annexation of this territory have on the existing level
of city/district services (i.e., need for additional emergency service personnel or
construction of new facilities, etc.)? The annexation of this territory will have
minimal affect on near term level or capability of the City to provide needed ser-
vices. The project will likely require additional City Police Officers to maintain
the current level of city police protection.
Would city/district require any upgrading or change in facilities to serve affected
territory (roads, fire hydrants, mains, etc.)? If so, would city/district or residents
be responsible for financing? The City will not require any upgrading or c~nges in
existing facilities as a prerequisite for annexation. The territory consists of an
established area that has been built out for a number of years. In case any addi-
tional development should occur, the developer shall provide and pay for major im-
provements or facilities.
Indicate and explain existing zoning in affected territory. The subject territory
is presently zoned R-1 (Low-Density Residential), R-2 (Medium Density Residential,
R-2 PD (Medium Density Residential-Precise Development Combining) zone R-3 (High Den-
sity Residential, R-3 PD (High Density Residential-Precise Development combining)
zone, C-1 (Neighborhood Commercial), C-1PD (Neighborhood Co~rercial-Precise develop-
ment combining) C-O (Cc~mercial) Zone and C-2 (General Cu~,~ercial) in the County.

Indicate and explain proposed prezoning in area. (List effects on present land
use that would occur as a result of annexation such as maintenance of livestock
on property, etc). The proposed prezoning or Zoning Upon Annexation will be
City R-1 (One Family Dwelling), R-2 (Limited Multiple Family Dwelling, one dwelling
per 2,500 square feet) R-3 (Limited Multiple Family Dwelling, one dwelling per 1,250
square feet), and C-1 (Limited Commercial). See attached map for specific zoning
areas (Page 5).

VII.
List city/district services that area will directly or indirectly benefit from such as
decrease in fire insurance rate, shorter emergency response time, use of co~unity
facilities, etc. City police should be able to respond in a more timely manner than
the present County Sheriff and State Highway Patrol. Current City Police standard is
higher sworn officer per 1,000 population percentage compared to the County standard.
Re~use service will be provided by the City and will result in savings to the owners
within this annexation. No special assessments or charges for street sweeping, leaf
collection, school crossing guards, street lighting energy costs and fire hydrants.

List existing tax rate(s) in area. The existing tax rate in area equals 1.129392% of
assessed market value. This represents the total property tax rate. When annexed
a designated percentage of the total tax of the area will accrue to the City. (Rate
as shown on 1991-92 County Auditor-Controller Tax Rate List).
Would effected area be subject to any bonded indebtedness of the city/district: If
so, explain. Yes, the tax rate for City bonds equals 0.002502% of assessed market
value. When annexed, the total tax rate will be 1.131894%. (Rates as shown on
1991-92 County Auditor-Controller Tax Rate List)
How will the difference in tax rates affect a house with a market value of $50,000.00?
The yearly tax would increase by the amount of $1.25 on a house of $50,000 market val,~e
due to inclusion of the City Bond Rate.
