A RESOLUTION ORDERING THE
DISCONTINUED USE OF THE DRAINAGE
EASEMENT OVER LOT 45 OF TRACT 2690
IN THE CITY OF BAKERSFIELD (ALISAL
AVENUE)°

WHEREAS, by deed recorded January 14, 1963 in Book 3563
Page 992 of Official Records the County of Kern acquired an
easement for drainage purposes over Lot 45 of Tract 2690, commonly
known as Assessor's Parcel Number 405-132-12; and
WHEREAS, the County of Kern transferred this drainage
easement to the City of Bakersfield by deed recorded April 11,
1973 in Book 4779, Page 2004 of Official Records; and
WHEREAS, said drainage easement is subject to a
condition subsequent that if the property is not used for drainage
purposes that title to said easement will revert to the original
grantor or its successors or assigns; and
WHEREAS, the City of Bakersfield has discontinued use of
this property for drainage purposes.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Bakersfield as follows:
1. All the foregoing recitals are found to be true and
correct.
2. The use of the drainage easement over Lot 45 of
Tract 2690, in the County of Kern, State of California, as per Map
thereof recorded January ii, 1963 in Book 13, Pages 105, 106 and
107 of Maps, in the Office of the Kern County Recorder, has been
discontinued and therefore reverts to the original grantor or its
successors or assigns.
3. The action herein taken is exempt from the
requirements of the California Environmental Quality Act because
there is no possibility that the action may have a significant
effect on the environment.
4. The City Clerk shall certify to the passage of this
Resolution and shall cause a certified copy hereof, attested by
the Clerk under the seal of the City, to be recorded in the Office
of the County Recorder of the County of Kern, California.
