A RESOLUTION MAKING FINDINGS AND APPROVING
SPECIFIC PLAN AMENDMENT 1-91 OF PROPOSED
AMENDMENT TO THE RIVERLAKES RANCH/UNIBELL
SPECIFIC PLAN.
WHEREAS, the Planning Commission of the City of Bakersfield, in
accordance with the provisions of Section 65353 of the Government Code, held a public
hearing on THURSDAY, OCTOBER 3, 1991, on Specific Plan Amendment 1-91 of a
proposed amendment to the Riverlakes Ranch/Unibell Specific Plan, notice of the time
and place of hearing having been given at least ten (10) calendar days before said
hearing by publication in the Bakersfield Californian, a local newspaper of general
circulation; and
WHEREAS, such Specific Plan Amendment 1-91 of the proposed amendment to
the Riverlakes Ranch/Unibell Specific Plan Amendment is as follows:
Specific Plan Amendment 1-91
Milazzo and Associates representing Unibell International
Co., Ltd., has applied to amend the Riverlakes Ranch/
Unibell Specific Plan consisting of changing Riverlakes
Ranch Drive to Main Plaza Drive and Creekside Drive to
Riverlakes Drive;
and
WHEREAS, by Resolution No. 77-91 on October 3, 1991, the Planning
Commission recommended approval and adoption of Specific Plan Amendment
1-91 and this Council has fully considered the findings made by the Planning
Commission as set forth in that Resolution; and
WHEREAS, the Council of the City of Bakersfield, in accordance with the
provisions of Section 65355 of the Government Code, conducted and held a public
hearing on WEDNESDAY, NOVEMBER 21, 1991, on the above described Specific Plan
Amendment 1-91 of the proposed amendment to the Riverlakes Ranch/Unibell Specific
Plan, notice of time and place of the hearing having been given at least twenty-one (21)
calendar days before the hearing by publication in the Bakersfield Californian, a local
newspaper of general circulation; and
findings:
WHEREAS, the Council has considered and hereby makes the following
1. All required public notices have been given.
2. The provisions of CEQA have been given.
3. The proposed Specific Plan Amendment will not have a significant
adverse effect on the environment.
4. Public necessity, convenience, general welfare and good planning
practice justify the proposed Specific Plan Amendment.
5. The proposed Specific Plan Amendment will be compatible with
existing and future development in surrounding areas and the project area.
6. The project does not have the potential for causing a significance effect
on the environment and under the California Environmental Quality Act Guidelines
"general rule" (Section 15061 State Administrative Code) is exempt from the California
Environmental Quality Act.
NOW, THEREFORE, BE IT RESOLVED and found by the Council of the
City of Bakersfield as follows:
1. The above recitals and findings, incorporated herein, are true and
correct.
2. The report of the Planning Commission, including maps and all reports
and papers relevant thereto, transmitted by the Secretary of the Planning Commission to
the City Council, is hereby received, accepted and approved.
3. The City Council hereby approves and adopts Specific Plan
Amendment 1-91 of the proposed amendment to the Riverlakes Ranch Specific Plan,
constituting changes as shown on the map marked Exhibit "A," attached hereto and
incorporated as though fully set forth, for property generally located between Norris
Road, Rosedale Highway, Coffee Road and Calloway Drive.

I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by

PUBLIC HEARING - PROPOSED AMENDMENT RIVERLAKES
RANCI-I/UNIBELL SPECIFIC PLAN SPA 1-91
Commissioner Anderson abstained on this item due to a possible conflict of
interest in that his company is presently providing services for the applicant.
In response to a possible conflict of interest on the part of Commissioner Powers,
Ms. Marino said it may be best to disqualify himself.
Staff report was given.
Public portion of the hearing was opened; no one spoke in opposition.
Michael Dhanens was present representing the applicant.
Public portion of the hearing was closed.
Motion was made by Commissioner Messner, seconded by Commissioner
Rosenlieb to adopt resolution making findings set forth in the staff report,
approving the requested specific plan amendments changing Riverlakes Ranch
Drive to Main Plaza Drive and Creek Side Drive to Riverlakes Drive as shown on
Exhibit "A". Motion earned by the following roll call vote:
