A RESOLUTION APPROVING AND AUTHORIZING THE
MAYOR TO EXECbT~- -~UPpL]~(ENTAL AGRE~ NO.
06R033 WITH THE STATE OF CALIFORNIA, DEPART-
MENT OF TRANSPORTATION, CITY AGREEMENT NO.
91-245 ("H" STREET UNDERPASS G~ADE SEPARATION
PROJECT).
WHEREAS, Consent to State of California Agreement No.
06R033, City of Bakersfield Agreement No. 91-245 between the State
of California, Department of Transportation, (hereinafter
"Department") and the City of Bakersfield (hereinafter "City")
covers the 1991-92 Supplemental Allocation from the Grade
Separation Fund for the "H" Street Underpass and State Road
6-KER-00-BKD Priority No.5, 1985-86 and it is in the interest of
both parties that such agreement be executed; and
WHEREAS, Department requires a Resolution from the
governing body of the City authorizing the Mayor to execute the
above-mentioned Agreement No.06R033, City of Bakersfield Agreement
No. 91-245 ; and
WHEREAS, the Department agrees to pay the City the sum
of $454,239.83 from the Grade Separation Fund for the 1991-92
Fiscal Year, bringing the total of allocations to the City to
$4,758,239.83, which is eighty percent (80%) of the total cost of
the participating portion of the "H" Street Grade Separation
Project; and
W~RREAS, the additional allocation in the amount of
$454,239.83 was approved by the California Transportation
commission, acting by and through the Director of Transportation
on September 4, 1991.
NOW, THEREFORE, BE IT RESOLVEDby Council of the City of
Bakersfield as follows:
1. 1991-92 Supplemental Allocation Agreement No. 06R033
is hereby approved; and
2. The Mayor of the City of Bakersfield is hereby
authorized to execute Supplemental Allocation Agreement No.
06R033, City of Bakersfield Agreement No. 91-245; and
3. The City Clerk shall certify the passage of this
Resolution and shall cause a certified copy hereof, and two (2)
executed copies of the agreement, to be mailed to the State
Department of Transportation, Division of Structures, P.O. Box
942874, Sacramento CA 94274-0001.
I HEREBY CERTIFY that the foregoing Resolution was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on N0V 2 0 199~ , by the following
vote:
