A RESOLUTION APPROVING THE PROPOSED
NEGATIVE DECLARATION FOR THE HOSKING SEWER
BENEFIT ASSESSMENT DISTRICT 91-1 AND HOSKING
SEWER TRUNK LINE.
WHEREAS, the proposed Negative Declaration is for the following:
Hosking Sewer Benefit Assessment District 91-1 and
Sewer Trunk Line
Proposed formation of Hosking Sewer Benefit Assessment
District 91-1 containing properties within both City of
Bakersfield and County of Kern to finance construction of
the $2 million Hosking Sewer Trunk Line south of Arvin-
Edison Canal, west of Union Avenue, north of McKee Road
and generally east of Akers Road.
and
WHEREAS, for the above-described project, an Initial Study was
conducted and it was determined that the proposed project would not have a significant
effect on the environment and a Negative Declaration with mitigation was prepared and
posted on September 25, 1991, accordance with CEQA; and
WHEREAS, the law and regulations relating to the preparation and
adoption of Negative Declarations as set forth in CEQA and City of Bakersfield
Resolution 107-86 have been duly followed by the city staff and the Planning
Commission;
and
WHEREAS, the Council of the City of Bakersfield approved the Public
Services and Land Use Elements of the Metropolitan Bakersfield 2010 General Plan;
and
WHEREAS, the Public Services Element set forth goals and policies for
sewer service in the planning area; and
WHEREAS, it is a goal of the Public Services Element to provide adequate
sewer service to serve the needs of existing and planned development in the area; and
WHEREAS, the Hosking Assessment District 91-1 will finance construction
of sewer trunk lines in the area, allowing urban development as approved under the
Metropolitan Bakersfield 2010 General Plan; and
NOW, THEREFORE, BE IT RESOLVED and found by the Council of the
City of Bakersfield as follows:
1. The above recitals and findings, incorporated herein, are true and
correct.
2. The Negative Declaration, with mitigation listed in Exhibit "A", for
Hosking Sewer Benefit Assessment District 91-1 and Sewer Trunk Line is hereby
approved and adopted.
3. The proposed project, as mitigated, would not have a significant adverse
effect on the environment.
4. Public necessity, convenience, general welfare and good planning
practices justify the project.
5. The proposed Assessment District and Sewer Trunk Line project will be
consistent with development in the project area.
6. The City Council hereby approves and adopts Hosking Benefit
Assessment 91-1 and Sewer Trunk Line project constituting changes as shown on the
map marked Exhibit "B", attached hereto and incorporated as though fully set forth, for
property generally located south of Arvin-Edison Canal, west of Union Avenue, north of
McKee Road and generally east of Akers Road.

I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by
the Council of the City of Bakersfield at a regular meeting thereof held

Hosking Sewer Trunk Line
Assessment District 91-1
Mitigation Measures
A qualified biologist must complete a biological survey over the sewer trunk line
alignments according to the requirements of the Metropolitan Bakersfield Habitat
Conservation Plan Advisory Notice, prior to any ground disturbance.
Project shall be reviewed by the Southern San Joaquin Valley Archaeological
Inventory and if an archaeological survey is recommended, such study and all
required mitigation measures thereto, shall be completed prior to ground
disturbance.
