A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD
ORDERING THE SU~4ARY VACATION OF THE WESTERLY PORTION
OF THE 33 FOOT WIDE Af.r.RY IN BLOCK 324 (IN CITY (Tm~IED
PROPERTY) IN THE CITY OF BAKERSFIELD.
WHEREAS, Chapter 4 of Part 3 of Division 9 of the Streets and Highways
Code authorizes the City Council to sun~arily vacate rights-of-way; and
I~IEREAS, The CITY OF BAKERSFIELD POLICE DEPARTMENT petitioned the
Council to vacate the excess right-of-way for an alley within city-owned property
in the westerly portion of Block 324, described in full in Exhibit "A" and
depicted in Exhibit "B", attached hereto and incorporated as though fully set
forth herein; and
WIqEREAS, the subject alley right-of-way is eligible for sun~ary vacation
on the basis that the alley right-of-way is excess right-of-way no longer needed
for public alley purposes; and
WHEREAS, the alley right-of-way is unnecessary for present or prospective
public alley purposes; and
WHEREAS, the Planning Commission, at its meeting of October 3, 1991,
considered and found that the proposed vacation is consistent with the General
Plan of the City of Bakersfield.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
1. All the foregoing recitals are found to be true and correct.
2. The proposed vacation is consistent with the General Plan of the
City of Bakersfield.
3. In accordance with Section 8334 of the California Streets & Highways
Code, the excess right-of-way for the westerly portion of the 33 foot wide alley
(in city-owned property) in Block 324, described in Exhibit "A" attached hereto
and incorporated as though fully set forth herein, is excess right-of-way no
longer needed for public alley purposes.
4. The action herein taken is exempt from the requirements of the
California $nvironmental Quality Act because there is no possibility that the
action may have a significant effect on the environment.
5. Pursuant to Chapter 4 of Part 3 of Division 9 of the Streets and
Highways Code, the above-described right-of-way is hereby vacated and shall no
longer constitute a public alley.
6. The City Clerk shall certify to the passage of this Resolution and
shall cause a certified copy hereof, attested by the Clerk under the seal of the
City, to be recorded in the Office of the County Recorder of the County of Kern,
California.

A portion of the 33 foot wide alley in Block 324 as said alley and block are
shown on "Map of the City of Bakersfield, Kern County California" filed November
25, 1898 in the Office of the Kern County Recorder, more particularly described
as follows:
Beginning at a point on the North line of said alley also being the Southeast
corner of Lot 3 of said Block 24;
THENCE South 00° 00' 00" West, 33.00 feet to a point on the South line of said
alley also being the Northeast corner of Lot 6 of said block;
THENCE South 90° 00' 00" West, along said South line, 76.94 feet;
~HENCE North 09° 01' 33" West, 33.41 feet to a point on the North line of said
alley;
THENCE North 90° 00' 00" East, along said North line, 82.18 feet to the point of
beginning.
RESERVING 1%IEREFROM a nonexclusive easement and right of way for public utiities,
to lay, construct, operate, maintain, repair, reconstruct, change the size of or
remove pipelines, conduits, cable, wires, poles or any other structures, fixtures
or equi~nent, in, under, across, over and upon the entire above described Parcel.
