A RESOLUTION OF APPLICATION PROPOSING
PROCEEDINGS FOR ANNEXATION OF TERRITORY TO
THE CITY OF BAKERSFIELD IDENTIFIED AS
ANNEXATION NO. 359, STINE NO. 8 ANNEXATION
(WARD 5).
WHEREAS, the Planning Commission of the City of Bakersfield, in
accordance with the provisions of Section 65353 of the Government Code, held a public
hearing on THURSDAY, MAY 2, 1991, on the proposed annexation of certain properties
to the City of Bakersfield known as STINE NO. 8 ANNEXATION, notice of the time and
place of hearing having been given at least ten (10) calendar days before said hearing by
publication in the Bakersfield Californian, a local newspaper of general circulation; and
WHEREAS, by Resolution No. 40-91 on May 2, 1991, the Planning
Commission recommended approval of the annexation by this Council and this Council
has fully considered the findings made by the Planning Commission as set forth in that
Resolution; and
WHEREAS, the City of Bakersfield desires to propose a change of
organization, to wit, the annexation to the City of Bakersfield of the hereinafter-
described territory, pursuant to Section 56800 of the Government Code of the State of
California.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield that it hereby finds and determines as follows:
1. That the City of Bakersfield hereby proposes the annexation to the City
of Bakersfield of the territory described in Exhibit "A" and shown on map marked
Exhibit "B", attached hereto and made a part of this resolution as though fully set forth
herein.
2. That a plan for providing services within the affected territory of the
proposed annexation, in accordance with the provisions of Section 56653 of the
Government Code, is marked as Exhibit "C", attached hereto and made a part hereof as
though fully set forth herein.
3. That this proposal for change of organization, to wit, annexation, is
made pursuant to the Cortese-Knox Local Government Reorganization Act of 1985, and
it is requested that proceedings be authorized for annexation in accordance therewith.
4. That the reasons for the proposed change of organization are that the
owners and residents of the affected territory desire to receive municipal services from
the City of Bakersfield, and the City desires to receive tax revenues for benefits given
and to be given to the territory proposed to be annexed.
5. That for this proposed annexation and the zoning upon annexation,
therefore, Ordinance No. 3401, which was adopted September 11, 1991, an Initial Study
was conducted and it was determined that the proposed project would not have a
significant effect on the environment. A Negative Declaration was prepared and posted
on April 11, 1991.
6. That the laws and regulations relating to the preparation and adoption
of Negative Declarations as set forth in the California Environmental Quality Act and
City of Bakersfield Resolution No. 107-86 have been duly followed and the Negative
Declaration for this proposed annexation is hereby approved and adopted.
7. That the territory proposed for annexation as described herein has been
determined to be inhabited pursuant to the Cortese-Knox Local Government
Reorganization Act of 1985, Section 56046 of the Government Code.
8. That the names of the officers of the City of Bakersfield who are to be
furnished with copies of the Executive Officer's Report and who are to be given mailed
Notice of Hearing, if any, are:

Commission of Kern County at 2700 "M" Street, Suite 302, Bakersfield, California 93301.

ANNEXATION NO. 359
A 90 foot-wide strip of land situated in the southwest 1/4 of Section 2, Township
30 South, Range 27 East, M. D. M., County of Kern, State of California, more
particularly described as follows:
Beginning at the point of intersection of the South lir~ of the North 45 feet of
Parcel 1 per Parcel Map No. 6951 (filed in Book 29 of Parcel Maps, Page 195 in
the Office of the Kern County Recorder) and the Westerly right of way line of the
Stine Canal, also being a point on the South right of way line of Belle Terrace
and a point on the existing corporate boundary of the City of Bakersfield;
THENCE (1) South 89° 22' 15" East, along said South (Right of Way) line, 92.88
feet to a point on the Easterly Right of Way line of the Stine Canal, also being
on the Westerly Right of Way line of Stine Road (County Road No. 157);
THENCE (2) South 14° 56' 22" West along said Stine Canal and Stine Road Right of
Way line, 629.40 feet;
THENCE (3) North 89° 22' 15" West, 92.88 feet to a point on the %~sterly Right of
Way line of the Stine Canal, also being the Northeast corner of the boundary line
of Tract No. 3813 (per map filed in Book 26 of maps, Page 128 in the Office of
the Kern County Recorder) and a point on the existing corporate boundary of the

Police- All police services in the City of Bakersfield are administered
through the City Police Department located at the southwest corner of
Truxtun Avenue and Eye Street about 3 miles northeast of thc annexation.
Fire- Station No. 7 at 4030 Soranno Drive is approximately 1/4 mile to
the south, and will service the subject area per City/County Joint Powers
Agreement.
Parks and Recreation- Patriots Park is located 1/2 mile to the Southwest.
Library- Not applicable.
Streets-
Construction/Maintenance; Sweeping; Lighting: The City Corporation
Yard on Truxtun Avenue, West of Freeway 99 will provide necessary
facilities, personnel and services to accommodate Public Works efforts.
Maintenance and personnel will be dispatched from the City Yard on a
regular basis for preventative maintenance as needed. Repairs include
streets, construction/maintenance, sweeping and lighting.
Sewer- An existing City sewer line. in Belle Terrace is available to this
area for connections. Effluent would then be treated by City Wastewater
Treatment Plant No. 3.
Water- This area is serviced by the California Water Service Company.
Other- REFUSE - Service will be provided by the City either by City force~
of by contract with a Franchise Refuse Collector.

vicinity of this annexation. First priori'

reasonable hours.

There will be no reduction in the range
of the City to provide the necessary public
works services to this area. Services will be
on a regular basis and "as needed."

III.
What effects, if any, would annexation of this territory
have on the existing level of city/district services
(i.e., need for additional emergency service personnel or
construction of new facilities, etc.)? The annexation of
this territory will not affect near term level or capabi-
lity of the City to provide needed services. The demand
for police protection in the area should not affect the
City's officers per 1000 population standard because no
residential development is proposed.
IV.
Would city/district require any upgrading or change in
facilities to serve affected territory (roads, fire hydrants,
mains, etc.)? If so, would city/district o__r residents be re-
sponsible for financing? The City will, require upgrading
or changes in existing facilities. The City requires as a
a condition of annexation, that the applicant shall reduce
the existing sign at the southwest corner of Belle Terrace
and Stine Road to a height not over 20 feet. As develop-
mmnt occurs, developers shall provide and pay for major im-
provements and facilities and dedicate them to the City.

Indicate and explain existing zoning in affected territory.
The whole territory is zoned County A-1 Limited Agri-
cultural) zone.
Indicate and explain proposed prezoning in area. (List
effects on present land use that would occur as a result of
annexation such as maintenance of livestock on property, etc).
The whole territory is prezoned City R-3 (Limited Multiple-
Family Dwelling) zone and is consistent with the Metropolitan
Bakersfield 2010 General Plan.

List city/district services that area will directly or
indirectly benefit from such as decrease in fire insurance
rate, shorter emergency response time, use of co~unity
facilities, etc. City police should be able to respond in a
more timely manner than the present County Sheriff and State
Highway Patrol services. Current City police standard is a
higher sworn officer per 1,000 population percentage compared
to the County standard. Refuse service will be provided by
the City and will result in savings to the owners within this
annexation. No special assessments or charges for street
sweeping, street lighting energy costs and fire hydrants upon
any future development of subject area.

A.
Please provide the following information relative to city/dis-
trict and county taxes: List existing tax rates (s) in area.
Existing tax rate in area equals 1.158160% of assessed market
value. This represents the total property tax rate. When
annexed, a designated percentage of the total tax of the area
will accrue to the City. (Rate as shown on 1990-91 County
Auditor-Controller Tax Rate List).
Would effected area be subject to any bonded indebtedness of
the city/district: If so, explain. Yes, the tax rate for City
bonds equals 0.004041% of assessed market value. When annexed,
the total tax rate will be 1.162201%. (Rates as shown on 1990-
91 County Auditor-Controller Tax Rate List).
How will the difference in tax rates affect a building with a
market value of $50,000? The yearly tax rate would increase by
the amount of $2.02 on a building of $50,000 market value due
to inclusion of the City Bond Rate.
