MT DIBTRZCT NO. 91-1 (HOSKZNG THIJNK SEWER) NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAKERSFIELD as follows: WHEREAS, all of the owners of more than 60% in area of the property subject to assessment therefor have signed and filed with the City Clerk of the City of Bakersfield a written petition for the improvements meeting the requirements of Section 2804.5 of the Streets and Highways Code of the State of California, as applicable, and for undertaking proceedings pursuant to special assessment and assessment bond acts, and to assess the costs thereof upon the properties benefited, and waiving proceedings under Division 4 of the Streets and Highways Code, for the construction and acquisition of improvements set forth in Exhibit "A" attached hereto and by reference incorporated herein; and WHEREAS, the costs and expenses of said contemplated improvements are to be chargeable upon an assessment district, the exterior boundaries of which are the coterminous exterior boundaries of the composite and consolidated area shown on the map thereof on file in the office of the City Clerk to which reference is hereby made for further particulars; and WHEREAS, the public interest and convenience will be served by the taking of said proceedings; NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED AND ORDERED AS FOLLOWS: 1. That all of the owners of more than 60% in area of the property subject to assessment for the construction and acquisition of improvements described in Exhibit "A," have signed and filed with the City Clerk of this City a written petition for the construction and acquisition of improvements pursuant to appropriate special assessment and assessment bond acts, without further compliance with the provisions of Division 4 of the Streets and Highways Code. 2. That said proceedings for the construction and acquisition of said improvements shall be had pursuant to the Municipal Improvement Act of 1913 and the bonds upon the unpaid assessments thereof shall be issued pursuant to the Improvement Bond Act of 1915. 3. That the provisions of Division 4 of the Streets and Highways Code be, and they are hereby, dispensed with. The descriptions of the Improvements and the termini of the proposed work do not necessarily extend for the full length of the description thereof. The plans and profiles of the improvements shall be controlling as to the correct and detailed description thereof. The improvements are generally described as follows: The proposed Assessment District No. 91-1 ("AD 91-1 ") is generally bounded on the north by the Arvin-Edison Canal, on the east by South Union Avenue, on the south by Astor Avenue, McKee Road, and Hosking Road, and on the west by a line parallel to and approximately one-quarter mile west of Akers Road. The district is planned as a combination City improvement construction and property owner constructed improvement acquisition financing program. The improvements to be constructed and acquired include the easterly extension of the Hosking Road Trunk Sewer from an existing lift station at Akers Road to South Union Avenue and, also, the installation of lateral main sewers that will extend City sewer service availability north and south of Hosking Road within AD 91-1. Lateral main sewers are planned for installation in existing Akers and Wible Roads, South H Street and South Union Avenue and in easements along the north/south mid- section lines within AD 91-1 where there are no existing streets. The doing of all incidental work and payment of expenses therefor as required to complete the foregoing work including, but not limited to, the reimbursement of the cost and expenses incurred by the Assessment District property owners to prepare construction plans for the improvements, including design surveys, site surveys to locate existing underground pipelines in the alignment of the proposed improvements, soils testing and compaction related to the design of the improvements, City Environmental Review Processing and Plan Check Fees. The reimbursement of Assessment District Formation and processing costs advanced to the City for the Assessment District proceeding and all associated district formation and administration costs and expenses as authorized by the Streets and Highways Code of the State of California. Page 1 of 2 The funding is not to exceed two years of capitalized interest on any bonds issued in the amount of the unpaid assessments, where said bonds are to be issued and sold pursuant to the Improvement Bond Act of 1915 (the "1915 Act"). The acquisition of real property other than that described herein and not already held by the City, where all said real property acquisitions are necessary and convenient in connection with the construction and operation of the improvements to be constructed. The levy of an annual assessment to pay costs incurred by the City from the administration of and collection of assessments, or from the administration or registration of any associated bonds and reserve or other related funds, pursuant to Subdivision (f) of Section 10204 of said Streets and Highways Code.
