HomeMy WebLinkAboutRES NO 137-91RESOLUTION NO.'I 3 7 - 9 1 A RESOLUTION FINDING THAT LITTER ON PROPERTY AT 722 LAKE STREET, BAKERSFIELD, CONSTITUTES A NUISANCE AND ORDERING THE BUILDING DIRECTOR TO PROCEED WITH ABATE- MENT. WHEREAS, in accordance with the requirements of Chapter 8.29 of the Bakersfield Municipal Code, the Building Director on May 2, 1991, gave to the owner of real property located at 722 Lake Street, Bakersfield, Notice to Clean Premises of litter or to show cause before this Council this date why such accumulation of litter should not be found to constitute a public nuisance and the same ordered abated; and WHEREAS, the Notice to Clean Premises specified that failure of the owner to abate any nuisance found by this Council to exist would result in the City abating the nuisance and the costs thereof being assessed against and becoming a tax lien on the premises; and WHEREAS, the City Clerk of the City of Bakersfield set WEDNESDAY, JUNE 5, 1991, at the hour of 7:00 P.M. (or as soon thereafter as the matter may be heard) in the Council Chambers of the City Hall, 1501 Truxtun Avenue, Bakersfield, California, as the time, date and place of hearing on notice to clean premises and the owner of the property located at 722 Lake Street was duly informed of her right to appeal said abatement order at any time prior to the conclusion of the hearing on the proposed abatement; and WHEREAS, the property owner appeared at said hearing and the City Council agreed to grant the owner six weeks to abate the nuisance and return to a hearing before the City Council on July 17, 1991; and WHEREAS, the nuisance has not been abated within the time specified in the Notice to Clean Premises or prior to the date of this hearing; and WHEREAS, the Building Director has reported to the Council as to conditions on the premises located at 722 Lake Street, Bakersfield, and the owner of such premises has been afforded an opportunity to show cause why a nuisance should not be found to exist thereon and ordered abated. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: and 1. The recitals set forth above are true and correct; 2. The notice requirements of Section 8.29.110 of the Bakersfield Municipal Code have been duly met; and 3. A public nuisance is found located at 722 Lake Street, Bakersfield, litter on such premises; and to exist on property by the accumulation of 4. The Building Director is ordered to proceed with the work abating such nuisance pursuant to the provisions of Chapter 8.29 of the Bakersfield Municipal Code. .......... o0o ..........
