A RESOLUTION NOTIFYING THE CALIFORNIA
INTEGRATED WASTE MANAGEMENT BOARD
THAT THE CITY OF BAKERSFIELD WILL NOT
RAVE ADOPTED A SOURCE ~nUCTION AND
RECYCLING ELEMENT BY JULY 1, 1991.
WHEREAS, as initially enacted, the California
Integrated Waste Management Act of 1989 (Public Resources Code
40000 et seq), hereinafter, the "Act", required all cities and
counties to prepare and adopt, on or before July 1, 1991, a
Source Reduction and Recycling Element; and
WHEREAS, as initially enacted, the Act also provided
that a Household Hazardous Waste Component containing a program
and implementation schedule for the collection, treatment and
disposal of hazardous waste generated by residences within the
jurisdiction would be a part of the Source Reduction and
Recycling Element; and
WHEREAS, Sections 41500 and 41510 of the Act were
subsequently amended to provide that the program for the
collection, treatment and disposal of hazardous wastes which are
generated by households in the jurisdiction and which should be
separated from the solid waste stream would no longer be a
component of the Source Reduction and Recycling Element, but an
element in and of itself; and
WHEREAS, Sections 41000 and 41300 of the Act were
further amended to provide that if a county or city is unable to
comply with the July 1, 1991, deadline for adopting its Source
Reduction and Recycling Element or the environmental review
associated with the adoption of the element, it may adopt a
resolution stating the reasons it is unable to comply with the
deadline and submit the resolution to the California Integrated
Waste Management Board; and
WHEREAS, the eleven incorporated cities within Kern
County, along with the County of Kern, are in the process of
preparing a Source Reduction and Recycling Element and Household
Hazardous Waste Element; and
WHEREAS, Kern County and the eleven incorporated cities
within Kern County have hired a consultant to assist in the
preparation of an environmental impact report associated with the
adoption of the Source Reduction and Recycling and Household
Hazardous Waste Elements by the twelve jurisdictions; and
WHEREAS, the environmental impact report will not be
completed prior to July 1, 1991, because the present timelines do
not allow for the required review periods according to the
California Environmental Quality Act.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Bakersfield as follows:
1. The City of Bakersfield will be unable to comply
with the July 1, 1991, deadline for the preparation and adoption
of a Source Reduction and Recycling Element because the
preparation of the environmental impact report associated with
the adoption of the element will not be complete.
2. The City of Bakersfield anticipates that it will
complete and certify the environmental impact report associated
with the adoption of the Source Reduction and Recycling Element,
and adopt a Source Reduction and Recycling Element for the City
on or before the required deadline as stated in California Public
Resources Code ~ 41300.
3. The Director of Public Works is directed to forward
a copy of this Resolution to, and otherwise notify, the
California Integrated Waste Management Board that the City of
Bakersfield will not have adopted a Source Reduction and
Recycling Element or certified the environmental impact report
associated with those elements by July 1, 1991.
