I 9 6 ' 0 4 A RESOLUTION REQUESTING THE KERN COUNTY LOCAL AGENCY FORMATION COMMISSION TO APPROVE A REVISION OF THE CITY'S SPHERE OF INFLUENCE AND ADOPTION OF A NEGATIVE DECLARATION. WHEREAS, a Sphere of Influence (SOl) defines an area for the probable physical boundaries and service area of a local government agency; and WHEREAS, the Local Agency Formation Commission (LAFCO) is required to determine the Sphere of Influence of each local government agency; and WHEREAS, LAFCO is required to update this SOl every 5 years; and WHEREAS, the last update to the City's SOl was 1998; and WHEREAS, there has been high demand for housing in the city and in some areas the city limits, SOl and existing development are coterminous at various city boundaries; and WHEREAS, a change to the SOl is necessary to accommodate future growth in a logical manner; and WHEREAS, if any city desires amendment of an adopted SOl, the City Council by resolution (pursuant to Section 56428 of the Government Code) may file a request therefore with the executive officer who shall present same for approval; and WHEREAS, a Municipal Services Review is required with said request and has been prepared for this SOl revision; and WHEREAS, all the eight areas shown on the attached SOl map (Exhibit A) reflect property owners desires to be included in the requested SOl; and WHEREAS, a negative declaration was prepared for the project; and NOW, THEREFORE, BE IT RESOLVED AND FOUND BY THE COUNCIL OF THE City OF BAKERSFIELD as follows: 1. The above recitals and findings incorporated herein, are true and correct. The negative declaration is approved and adopted. Staff is directed to make application to LAFCO to amend the Sphere of Influence. 4. The Municipal Services Review is to be included in the application to LAFCO. 5. That the City Council hereby requests revision of the City of Bakersfield's adopted Sphere of Influence by the Kern County Local Agency Formation Commission under the provisions of Government Code Section 56428, to add lands that could be annexed and served by the City of Bakersfield in the future, as shown on the attached map Exhibit "A". 6.
