HomeMy WebLinkAboutMay 6, 2004 PLANNING COMMISSION OF THE CITY OF BAKERSFIELD MINUTES OF MAY 6, 2004 — 5:30 p.m. Council Chambers, City Hall, 1501 Truxtun Avenue Due to a malfunction in the recording equipment the following minutes were taken from notes. 1. ROLL CALL Present: Commissioners Gay, Tragish, Blockley, Ellison, Lomas, Spencer, Tkac Absent: None Advisory Members: Alan Shaw, Marc Gauthier, Marian Shaw, Jack Leonard Staff: Louise Palmer, Pam Townsend 2. PLEDGE OF ALLEGIANCE: 3. PUBLIC STATEMENTS - None 4. CONSENT CALENDAR: 4.1 Non-Public Hearing Items 4.1 a Approval of minutes for Planning Commission meeting of March 18, 2004. 4.1 b Approval of General Plan Consistency finding for the Greenfield Union School District for the acquisition of a parcel. (Greenfield School District). (Exempt from CEQA) (Ward 7) 4.1 c Approval of General Plan Consistency finding for vacation of a portion of an alley between Oak Street and Olive Street, extending from Palm Street to Dracena Street. (Golden Empire Design). (Exempt from CEQA) (Ward 2) Motion made by Commissioner Ellison, seconded by Commissioner Spencer, to approve the non-public hearing portion of the Consent Calendar. Motion carried by group vote. 4.2 Public Hearing Items 4.2a Approval of Extension of Time for Tentative Tract 5966 (Delmarter and Deifel) (Ward 4) 4.2b Approve continuance to May 20, 2004 of Street Name Change from Windsong Street to Ashley Castle Way (Brian Allan Castle) (Ward 4) Minutes, PC, May 6, 2004 Page 2 4.2c Approval of Vesting Tentative Tract Map 6303 (Porter-Robertson) (Ward 5) Public portion of the hearing opened. No one spoke either for or against the projects. Public portion of the hearing closed. There were no Commission comments. Motion made by Commissioner Blockley, seconded by Commissioner Tkac, to approve the public hearing portion of the Consent Calendar. Motion carried by group vote. Agenda Item 8 (Tentative Parcel Map 10928) was heard at this time. 8. PUBLIC HEARING —Tentative Parcel Map 10928 (Pinnacle Engineering) (Ward 3) In order to try to work out an agreement between the applicant and nearby homeowners, it was agreed that this item be continued until May 20, 2004. Motion made by Commissioner Ellison, seconded by Commissioner Spencer, and passed by the following roll call vote: AYES: Commissioners Blockley, Ellison, Lomas, Spencer, Tkac, Tragish, Gay NOES: None ABSENT: None 5. PUBLIC HEARING — Proposed Amendment to City's CEQA Implementation Procedures. (Exempt from CEQA) Staff report given recommending approval. The following spoke in opposition to the project: Lois Watson, Mrs. Arthur Unger, Mary Griffin, Gerald Foster and Renee Nelson. They feel that the public has a right to public hearings. They feel that a hearing on Draft EIR's is important for the public to be able to speak either for or against the project. All of them wanted the city to continue with the current process. After some discussion the Commission agreed and denied the project. Staff suggested the Commission send the item to a committee for further evaluation but the Commission did not agree. Commissioner Tragish made a motion, seconded by Commissioner Tkac, to deny the proposed ordinance amendment. The motion was carried by the following roll call vote: AYES: Commissioners Blockley, Ellison, Lomas, Spencer, Tkac, Tragish, Gay NOES: None ABSENT: None 6. PUBLIC HEARING — Receive comments on the Draft Environmental Impact Report for the Allen Road Crossing Over the Kern River. (City of Bakersfield) (Draft EIR) (Ward 4) Minutes, PC, May 6, 2004 Page 3 A representative from Michael Brandon and Associates gave a slide show presentation giving an overview of the project. Public portion of the hearing opened. Arthur Unger read a letter to the Commission stating that the public needs to use public transit instead of building more bridges over the Kern River. He said we must plan for the congestion increasing population will cause and that we need to prevent the air pollution that will come from this bridge when it eventually becomes congested. Mr. Unger also said the EIR should contrast the expense of roads with the expense of light rail and that bicycle lanes should be class one, not the proposed class two. Bicyclists approaching the bridge should confront a sign warning them of the effect the emissions of bridge traffic will have on their lungs. Public portion of the hearing closed. There was little discussion on the project by the Commission. AYES: Commissioners Blockley, Ellison, Lomas, Spencer, Tkac, Tragish, Gay NOES: None ABSENT: None 7. PUBLIC HEARING — Street Name Change from Windsong Street to Ashley Castle Way (Brian Allan Castle) (Ward 4) See Consent Agenda 8. PUBLIC HEARING —Tentative Parcel Map 10928 (Pinnacle Engineering) (Ward 3) This item was heard and continued earlier on the agenda. 9. PUBLIC HEARING —Vesting Tentative Tract Map 6303 (Porter-Robertson) (Ward 5) See Consent Agenda 10. COMMUNICATIONS: 11. COMMISSION COMMENTS: Commissioner Tragish commented that he did not like receiving the Planning Commission reports on CDs. 12. ACKNOWLEDGMENT OF RE-APOINTMENT OF COMMISSIONER TKAC AND APPOINTMENT OF CHAIRMAN AND VICE-CHAIRMAN: Minutes, PC, May 6, 2004 Page 4 Motion made by Commissioner Tkac, seconded by Commissioner Spencer, to nominate Commissioner Tragish Chairman. Motion carried by group vote. Motion made by Commissioner Blockley, seconded by Commissioner Lomas, to nominate Commissioner Ellison, Vice Chairman. Motion carried by group vote. Motion made by Commissioner Tkac, seconded by Commissioner Blockley, to allow the new Chairman to set seating arrangements. Motion carried by group vote. 13.
