HomeMy WebLinkAboutRES NO 194-04RESOLUTION NO. ! 9 Z[ - 0 z~ A RESOLUTION APPROVING A GRANT APPLICATION FOR RECEIPT OF THE STATE OF CALIFORNIA OFF HIGHWAY MOTOR VEHICLE RECREATION TRUST FUNDS FOR OFF HIGHWAY VEHICLE ENFORCEMENT FUNDING AND EQUIPMENT PURCHASE. WHEREAS, the Bakersfield Police Department is faced with problems of Off Highway Vehicle trespass, illegal lodging, dumping, and vandalism of property in areas of the City of Bakersfield. WHEREAS, the Bakersfield Police Department is constrained by human and equipment resource funding to facilitate adequate enforcement of illegal Off Highway Vehicle riding areas. WHEREAS, the Bakersfield Police Department and the City of Bakersfield wish to secure State of California Off Highway Motor Vehicle Trust Funds for an enfomement grant in the amount of $31,104, $7,776 to be absorbed by the city for a 25% matching amount. WHEREAS, acceptance of grant enforcement monies will enable the Bakersfield Police Department to fund 648 hours of personnel overtime. Enforcement monies will facilitate patrol of illegal Off Highway Vehicle areas, the Kern River floodplain, and bike path. WHEREAS, the Bakersfield Police Department and the City of Bakersfield wish to secure State of California Off Highway Motor Vehicle Trust Funds for an equipment grant in the amount of $24,000. $7,350 to be absorbed by the city for a 25% matching amount. WHEREAS, acceptance of grant equipment monies will facilitate the necessary purchase (2) Off Highway Motorcycles, associated maintenance, supplies, and fuel (2) Police radios, (4) sets of riding gear and equipment. WHEREAS, the said grant program is allocated for the 2004-2005 budget year. Funding for future years must be reapplied through the State of California Off Highway Vehicle Trust Fund. Equipment purchased from the grant will be retained by the Bakersfield Police Department. WHEREAS, the Legislature and Governor of the State of California have approved the grants as shown above; and ORIGINAL WHEREAS, the State of California Department of Parks and Recreation has been delegated the responsibility for the administration of the grant, setting up necessary procedures; and WHEREAS, the State of California Department of Parks and Recreation require the applicant to certify by resolution the approval of application(s) before submission of said application(s) to the state; and WHEREAS, the said application(s) contain assurances that the applicant must comply with; and WHEREAS, the applicant will enter into an agreement with the State of California Department of Parks and Recreation for the subject grant. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: That the City Council of the City of Bakersfield approves the application to and receipt from the State Department of Parks and Recreation OHV Trust Fund for said grant monies. That the City council of the City of Bakersfield certifies that The Bakersfield police Department understands its assurances and certification in the application form. That the City Council of the City of Bakersfield certifies that the Bakersfield Police Department has reviewed and understands the General provisions contained in the state/local agreement shown in the Procedural Guide. That the City Council of the City of Bakersfield appoints its Chief of Police, or his designee, as agent to conduct all negotiations, execute and submit all documents including, but not limited to applications, agreements, amendments, payment requests and so on, which may be necessary for the completion of the aforementioned project(s). McVicker Subject: State of California Off-Highway Motor Vehicle Recreation Trust Funds Grant Application Administrative Report and Resolution. Enclosed is the Administrative Report and Resolution for above listed grant. The funds to be applied for will consist of the following: 1. ENFORCEMENT A. STAFFING- Total personnel hours submitted for the grant: 648 @ $48 per hour $31,104 B. MATCHING CITY FUNDS (must be 25% of total request)- Education and training: Administration of the grant: 116 hours @ $48 per hour $5,568 46 hours @ $48 perhour $2,208 $7,776 TOTAL PERSONNEL FUNDS REQUESTED FROM STATE (A - B) $23,328 · Matching funds are broken down into education, training and grant administration. A 25% match is required as a minimum. · These funds can be "in- kind" and will consist of reserve officers providing at least 52 hours of public education at various public events such as street fairs. · 64 hours of training will be provided for officers engaged in the operation of off-highway vehicles as an enforcement tool. ORIGINAL m EQUIPMENT A. The following equipment will be purchased with grant funds: (2) Gas FSE 450 Motorcycles @ 7,600 each $15,200 (4) Sets of off-road safety riding gear @ 1,550 each $6,200 Maintenance for two off-road motorcycles @ $1,300 each $2,600 (1) Decibel Meter @ $1,500 each $1,400 $25,400 B. The following will be provided by the Bakersfield Police Department as its 25% funding match for the grant: (2) Motorola XTS3000 portable radios @ $3,000 each $6,000 Off-road motorcycle fuel $680 $6,680 TOTAL FUNDS REQUIRED FOR ALL EQUIPMENT $32,080 TOTAL EQUIPMENT FUNDS REQUESTED FROM STATE (A- B) $25,400 · Two portable radios will be provided as "in-kind" match - $6,000 · Motorcycle fuel will be provided by the police department - $680 TOTAL OF ALL FUNDS REQUESTED FROM THE STATE TOTAL OF MATCHING CITY FUNDS OR "IN-KIND" MATCH $48,728 $14,456 (29.66%) TOTAL OF ALL MONIES REQUIRED FOR THE PROGRAM $63,184 ORIGINAL
