A RESOLUTION DECLARING REAL PROPERTY
SURPLUS TO THE NEEDS OF THE CITY AND
AUTHORIZING THE FINANCE DIRECTOR TO
NEGOTIATE ITS SALE
WHEREAS, the City owns a fee simple interest in property north of 8400
Stockdale Highway; and,
WHEREAS, Bakersfield University Partners, a California limited partnership has
requested the City sell this property described in Exhibit "A" and shown on Exhibit 'B"
attached hereto to facilitate its new commercial development.
WHEREAS, on May 20, 2004 the Planning Commission found the sale of this
property to be consistent with the Metropolitan Bakersfield 2010 General Plan pursuant
to Government Code Section 65402.
WHEREAS, Bakersfield Municipal Code 3.20.125 authorizes the negotiated sale
of City property deemed to be "surplus".
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield as follows:
1. The foregoing findings and recitals are true, correct, and incorporated
herein.
2. Real Property located north of 8400 Stockdale Highway is hereby declared
surplus to the City's needs and the Finance Director is authorized to negotiate its sale.
The real property is more fully described in Exhibits "A" and "B" attached hereto and
incorporated as though fully set forth.
I HEREBY CERTIFY that the foregoing Resolution was passed and
adopted by the Council of the City of Bakersfield at a regular meeting thereof held on
